Nepotism and Patronage in East Greenbush

Quoted below is a paragraph from an anonymous blog comment from East Greenbush Talks attacking the qualifications of a friend of mine related to his knowledge and experience in the "personnel officer" business.  I happen to know that Ray Mooney has had substantial career experience in the personnel field, and offered him an opportunity to respond. 

First the quote from the "genius" on Talks:

"Ray doesn't want to hear about the public sector. He only can relate to 
the private sector and the set of rules they follow. He obviously has no 
knowledge of hiring practices in the public sector , yet he chooses to 
target Town hiring policies ignorantly and like his blog partner 
Johnson, refuses to acknowledge their inadequacies and lack of education 
on the actual subject matter. Private sector experience is irrelevant to 
public hiring practices."
 
Here's Ray's response:
 
Don, I don't generally like to respond to cowardly nameless bloggers. But I am willing, in this case, to make an exception.

It is true that my only real exposure to public sector hiring is through what I am able to observe here in East Greenbush. What I have learned is that nepotism and patronage are pretty much the sole or single criteria for hiring. I would challenge my friends and neighbors on the Talks blog to supply facts and their names with any examples to the contrary. Please note: I am not drawing distinctions between the major political parties. I think when it comes to nepotism and patronage there is no political high ground and the best interests of the taxpayers are not being served.

Nepotism not an unknown practice in the private sector. It exists primarily in family owned and run businesses.

I do not recall the stats any more but some huge percentage of publicly held companies prohibit nepotism. Now, why exactly would that be? If nepotism was an advantage to the business; if nepotism advanced the business' goals and objectives you can bet your bottom dollar those businesses would not just allow but would encourage nepotism. But...a tremendous majority do not. There must be good or valid business reasons for that to be the case.

Patronage is only slightly different. Patronage passes taxpayer money to political cronies as a reward for support and, it has always seemed to me, to discourage dissent and criticism from within. I think patronage is kind of like "omerta" in organized crime.

In the private sector all companies have to, by law, offer employment equally to all qualified people regardless of race, age, gender, religion, national origin, and some other criteria. Companies that do business with the federal government have to take affirmative steps (called an Affirmative Action Plan or AAP) to make sure their hiring and other practices conform generally to the percentage of minorities in their business area. The Office of Federal Contractor Compliance Programs (OFCCP) audits affirmative action plans and supporting data.

Moving from a general discussion to specifics...

I think the fact that our town is in the financial condition it has been in during the recent past, is in now and, in the absence of any financial plan, will continue to be into the future is all that is needed to indicate that practices such as nepotism and patronage do not serve the best interests of the taxpayers of our town. I back up this assertion with the fact that the two most obvious nepotism appointments in our town of two town board members direct family were misrepresented to taxpayers last year and have been buried in some political never never land this year. If these appointments made good sense; if the taxpayer was seeing real benefit for her/his dollar these appointments would be something the town board was proud of and would share with the public - the very people paying for them. But, for 2012 and 2013 that was not the case.

I have heard that one potential candidate for town board has said that a primary campaign focus will be that this candidate has no family members or friends that are seeking jobs - how very telling.

Everything I wrote about diversity and leadership, or the lack thereof, in my earlier comment I stand by 100%. 

In summary - I guess nepotism and patronage were concepts that could be ignored when our town's financial performance was better. In today's financial reality and with the lack of a Town Board sponsored financial plan, nepotism and patronage do not seem to be concepts that serve the best interests of taxpayers.

I think it's a safe bet that the "public sector hiring practices" which our anonymous Talks commenter says Ray knows nothing about are the ways which the Town of East Greenbush uses to avoid using the Civil Service Law which is supposed to be in place to protect the public from patronage and nepotism in municipal hiring. Looks like some recent discoveries are making it apparent that the Town has not been attentive to the law in this area. Perhaps our friend at Talks could tell us why the recent Court Clerk appointment bypassed the law, and if this is what he's talking about as appropriate hiring practice in the public sector.

    Please feel free to name names of those who are not qualified to hold their positions and who was looked past and not hired due to patronage and nepotism. Were qualified people denied employment because of an illegal appointment?

  5. When a municipality is working properly, it accesses what services are most necessary for the good of all the people - and then goes about economically staffing up to provide the services. The service needs drive the staffing. Anything in excess of the service needs is personnel pork. Workload analysis should drive staffing. When that's done, what's patronage and nepotism will stand out like sore thumbs.

    And then there's the whole thing about Civil Service rules which are supposed to apply in municipalities..........

  6. When was the last time anyone saw the town reaching out for potential employees other than friends or relatives of those in power? And I believe a certain relative of a town board member actually lives in Saratoga. What is that person doing on the payroll?

    1. Lets be honest here, BOTH sides of the political aisle know exactly when a vacancy exists. If its that dramatic of a issue, I'm quite confident there would be more uproar. Once again I'll ask, exactly who has been hired illegally?

  7. Unfortunately Johnson and Mooney have lived in EG for a limited period of time. They have no idea how things were done in the70s through the 90s. They don't want facts they want something to spin and defame. PM

      both sides seem to follow with the practice of nepotism. it surely doesn't matter for this town to play games when it comes to our money and they have proven that time and time again.

Unless I miss my guess, if there exists an illegal civil service hiring, civil service de-certifies the Towns payroll and hamstrings all the remaining employees until the Town comes into compliance. I would think that maybe you disagree with the person hired , but I can only surmise that the Town has complied with civil service law.

  9. This could get interesting. I've heard that the Town Clerk's office DOES NOT have Civil Service position descriptions pursuant to Civil Service rules. It's just as easy to surmise that nobody has paid any attention at all to the civil service law for a long time. Maybe it's time to look.

  11. Town Hall - what about Civil Service ? They actually specify exactly what the "minimum" qualifications are. The Town must follow or risk financial sanctions. If any of you remember the Town of North Greenbush debacle from about 10 + years ago when they had civil service issues and lost a substantial amount of funding .

    1. Just one question, Anony from Talks...... Why do you feel the need to say such things? I'm the "elderly neighbor" here. Perhaps some of the topics we are addressing are hitting close to home and the personal attack is the only one available. The Civil Service matter is hard to "fix" if it hasn't been looked after over time. Maybe that's what's itching.

  15. Did anybody notice that the Ambulance District got an almost $200,000 increase in the 2013 Town Budget???? This sole source, no bid contract has been unexamined forever. We have called for an audit of the contractor for several years, but the relationship has been deemed to be too special to be examined. OSC reviews have found material to be pursued. The most important recommendation in recent years from OSC is that the operation should be brought "in house" and operated as a department of Town government.

    Perhaps it's time to put the service out for bid.

    1. Putting the service out to bid is exactly what should be done? Perhaps you should ask Mr. Malone why the Majority board won't allow for that process .

    2. All of us should be asking the entire Board why it will not pursue that course! The Ambulance District operation consumes more than $1,000,000 in tax and insurance revenue and the no-bid, single source contractor (for how many years?) has never been audited. If you look at the history, it is populated by some significant personages in Town politics, and that should tell you why a look under the tent flap has not taken place.

      I think it's interesting that Rick Matters got moved out as liaison, to be replaced by Sue Mangold. Perhaps Sue could show some leadership and call for an audit of the contractee and perhaps putting the operation out for bid. It's high time. There should be an answer to the question of why there is an increase of almost $200,000 in tax levy for 2013. Sue?????? No questions from the Board??? Just put the increase in the Budget????

    3. The Ambulance district is being totally mis-managed by its President, Chief and Operations manager. They are feeding the Town Board a line of garbage while they totally flush whats left down the drain. Many many people who know exactly whats going on have walked away in disgust.
      There once was a proud organization that is now squandering in filth and deception because of complete and total mis-management. Too bad the Town Board doesn't step in and demand resignations from the self serving Chief/President and operations manager, all three of which have questionable qualifications.

  17. Our town board and especially the majority has strongly, vigorously even, resisted audits.

    Taxpayers should recall that 19 of 19 Bruen members were receiving improper state retirement system credits.

    Taxpayers should also be aware that one of East Greenbush's fire district chiefs is under investigation for misappropriating $25,000. Would a proper audit have discovered that before it got to $25,000? Most probably yes. Is there an on-going cover up to not share the status of the investigation with the very people whose money may have been misappropriated? Most probably yes.

    The town board is either complicent or ignorant but in either case the taxpayers bear the brunt of such malfeasance.

    Maybe Mr. Stenson or Mr. Gilbert can add to this specific discussion?

    1. I think Langley, Matters, Malone, O'Brien and Mangold are those who should be adding to this specific discussion. They are the ones with the fiduciary responsibility for putting the tax levy in the budget and voting for it - and nailing the rest of us with the bill. Where are the questions and the review???     2. The current leadership @ Bruen is archaic at best. Self-serving and vindictive are probably more accurate.
      A $200,000 + budget increase shows exactly how incompetent the Chief operating officers and BOD are. That toilet needs to be flushed !

    3. The entire Town Board is the Board of Governors of the Ambulance District. If there is any ultimate responsibility for the operation of the District, it rests with the Board. The Board has refused over the years to address the problems which have existed with Bruen - which is the single source no bid contractor. It's been a "hands off the friends and neighbors" policy, and it has produced nothing but trouble.

    4. Thats not totally true Don. The Board of directors @ the Rescue Squad rules with absolution. They have been responsible for the downward decline and have been blowing sunshine up the collective butts of every single taxpayer in East Greenbush as well as the Town Board for the past ten + years.
      Once again - that toilet needs to be flushed - soon !
      The Rescue Squad can be salvaged to the benefit of the residents they serve, but not with this Board of Directors , nor with the current Chief of Operations or the man they hired to oversee the paid staff.

    5. The Town Board has the legal authority to hold the Board of Directors of the Rescue Squad accountable - if they had the guts to do it. The Town Board gives the contract to operate to the Rescue Squad. The legal authority to operate an Ambulance District rests with the Town Board, and the Town Board gives the contract to Bruen. If there is mischief going on and the Town Board does not provide the appropriate oversight, the Town Board (I believe) is ultimately responsible.

    7. In the history of the blogs in our town there is, for the moment, the most interesting and very positive development...

      This blog and some of its commenters and the Talks blog, and some of its commenters AGREE on the need to completely reform (bad word I know) Bruen.

      We know that all politicians follow the blogs.

      So, how about it town board members? Is it time for a real, deep maybe even forensic (another bad word, I know) audit of Bruen?

      Is it time for a real board of directors?

      Is it time to put the ambulance district out for bid?

      Is it time to manage the ambulance district as a town department?

      Is it time to (finally) really and truly take this issue on and DO something?

      It sure seems that way. And please no public committee on this one. You ignore the Ethics Board like they have the plague. The CFAC ceased being relevent about 5 minutes after their first meeting.

      Look into, think about it a little and DO something. Its not called leadership for nothing you know.

    8. Bruen is the red-headed step child of this Town Board. They-( the Town Board) need to take on some responsibility and develop a plan for accountability that the taxpayer can grab ahold of and understand.

  18. The last few audits have been a devastating indictment of the mismanagement of our town by a number of town boards last, and most certainly, present.

    If voters get offered any alternatives to incumbents in the 2013 election for two town board members voters should vote the incumbents OUT.

    This point especially applies to Ginny O'Brien. If Ms. O'Brien runs again voters need to recognize her contribution to the mismanagement of our town. From her vote against an ethics code to her husband's nepotism appointment to the games she led last year on the newly elected supervisor's salary debacle voters need to pick an alternative to Ms. O'Brien.

    Rick Matters seems to have either stopped caring because he is burned out or he has, much like Keith Langley, been rolled over by the majority.

    Our town need positive change and leaders who will lead that change. And the incumbents are simply not those leaders.

  19. Leadership at Bruen has been flawed for years. Inappropriate and illegal dealings with the volunteers have led to many walking away, and the rest being forced out by people with their own agenda. The Town Board is charged with "handling" the day to day operations of the rescue Squad. Its about time they took that charge seriously. The people currently " in charge" there are incompetent and ignorant and should be terminated immediately, so whats left of a very needed commodity can be salvaged for the benefit of the Town that they serve.

  20. Pay respectful attention to what the Supe has to say about this at tonight's town board meeting (7pm at town hall). He and his 5-0 town board will lead us in the best direction for the town. We can count on his strong leadership. If you can't make the town board meeting stop by town hall before lunch to talk with him. You will feel better.

The majority had two OSC audits of the District with significant findings and recommendations before the most recent one, but they didn't do squat. The signs of trouble were there and were pointed out in these documents

    2. You've got to be kidding!! I wonder if he's read the three audit reports on the Ambulance District. It would seem to be a requirement of the job to get up to speed on issues independent of the McCabe filter. I believe that the former Supervisor referred to the folks at Bruen as "friends and neighbors" as a piece of the excuse for not really doing anything about what OSC had surfaced in the District operations, so the former Supervisor may not be the best adviser on this matter, among others. He's go his own axes to grind.

  22. Well, all of you that were expecting anything regarding Bruen and tonight's town board gre going to be disappointed.

    Sue Mangold spoke glowingly about Bruen's leadership and the fact that the Bruen leadership attended Monday's CFAC meeting and shared the Bruen budget.

    A concerned citizen asked if there would be or should be a public hearing on the Bruen contract. There was a great deal of confusion as neither the town attorney (Joe Liccardi) or Supervisor Langley or anyone else was sure of the answer.

    The follow up questions asked if the Bruen contract should have been put out for bid per the town's procurement policy. That answer was no according to Sue Mangold because the Bruen contract is for professional services.

    The contract for Bruen (No. 13-2013) passed with a 5 to 0 vote and no comments from Supervisor Langley.

    The Bruen contract is now available on the town's web site.

Now they can't exert management authority because they failed to manage in the past and some untoward things took place that make them vulnerable as managers. It's "circle the wagons time" folks.

  25. The Town Board won't touch Bruen because of the "arrangement" for Bruen members, family and friends to be a vote source insuring the continued power of the Dem Majority. It's been going on for a long time, and will continue until somebody gets busted. The OSC audits have pointed the way for the Board to follow, and these documents actually give the Board the "cover" they need to act. But the Board lacks the courage to do the right thing. It's all about the power and the jobs folks. Just wait until it's time to let the contracts on the sewer project. You'll see more of the same.

  26. There are still a few good people left at Bruen, but most of them are not good people at all. They care about one thing and one thing only themselves. Its a shame because when Bruen was founded in 1937 it was founded on the principle of helping people, by people that were the most unselfish people you would ever want to know. If those old timers only knew they would all be rolling in their graves. Sorry folks but this is the way I see it, and as a former member, I guess I'm qualified to comment. Although I'm sure there will be many comments about me.

    Just a taste of some of the so called members there. A few years back we had a member that said he would plow the parking lot for us at the building. He had plowed the snow the winter before without a problem, he asked for gas money that was all. Not a bad deal. Before that we used to hire out to the lowest bidder, you know get three bids and take the lowest. Well anyways on with my story so this one year this so called member that was plowing the squad decides that with this one storm he wasn't going to plow, but he never says anything to anyone he just doesn't show up. So anyways we have a couple calls during the night, and the ambulances getting stuck right in are own parking lot. This had never happened before, and as far as I know hasn't happened since. Great member right? Yeah right. This was just his way of getting back at a certain member or two in the squad.

    Oh just one last thing before you anonymous people find it so nice to rip me apart, that could have been your family member (wife, husband, mother, father, son ,daughter) that we were trying to get to and it took us an hour to get there not because we were out on another call, but because we couldn't get out of are own parking lot.

    1. Hi Jim, was wondering when you would comment. I am also a former member-( life) and there are so many stories and parts of the squad that I am still proud of today , in spite of the current leadership.
      I am deeply saddened by this current "Chairman of the Board". She knows better but is clearly on a "power trip" and thinks she's doing no harm. Sad thing is that she obviously has the Town Board buffaloed into thinking she knows what she's doing , when in reality , nothing could be farther from the truth !
      Before anyone thinks that this is ALL the Town Boards fault - its not ! I will argue vehemently that the certain few "power trippers" @ the rescue squad should be dismissed and replaced by more competent and interested people. Until that happens, there will be controversy and dis-satisfied taxpayers.
      The political catch phrase applies here too- "transparency".!

    1. The Town Board is well aware of the issues with the contract. There are three OSC audits which outline the problems. And there are other issues indicated, but not outlined, in the OSC audits. The problem is that the Town Board has declined to take on the uncomfortable task of cleaning up the operation - beginning with an audit of the entity (Bruen) with which the Town Board contracts to operate the Ambulance District services. Nothing will happen until the Town Board majority looks beyond political expediency (getting elected) and exercises its fiduciary responsibility as Commissioners of the Ambulance District.

    2. Don't lose sight of this fact. The Langley led Town Board majority is now 5-0. There are no ethical or political differences between the Board members whatsoever. Langley, believe it or not, has acquired absolute control.

  30. Around our town board audits are a VERY, VERY bad word. Small wonder why.

    The OSC has taken a VERY, VERY dim view of the management of Bruen specifically and the entire town of East Greenbush generally in every recent audit.

    Really all the OSC was going was confirming the conclusion already reached by Moodys and Standard and Poors.

    But...nothing changes, nothing is done. My friends and neighbors it is the utter and complete ignorance and apathy of the citizens of this town that enables the incompetent, corrupt and lazy practices that get called governing around here.

    People who have made the case for the mismanagement of our town get made fun, blamed for everything from the Lindberg kidnapping and called names. I am pretty sure Mike Cristo was involved in the Kennedy asassination to believe the folks on Talks.

    So, we blog merrily along. Few of us go to meetings. Even fewer speak out or write effectively. And we vote like sheep for the same people who got us so deeply into the mess we are in.

    Dwight Jenkins, Don Johnson and other people cannot do it all by themselves. Equally it is not Chris DeFruscio's fault either.

    To quote Pogo: "We have met the enemy; and they is us." Stop complaining. YOU - the people who either don't know what's going on or know and don't care are, in very large part, the problem.

The few who put the good of the Town before themselves. I realize, most of their GREAT WORK was in vein, however, it is truly missed.   35. After reading the latest "crap" about Mike Cristo on the Talks blog I have reached a couple of conclusions.

    The most important is that whenever there is an issue in town, especially any issue dealing with how O'Brien, Mangold and Malone (as the governing majority) are running things the Talks bloggers trot out their hatred of Mike Cristo as a distraction. The very latest example is the Bruen matter. Bruen is BADLY run. Read the audits for crying out loud. But Mangold (in her town board role as liason to Bruen) either knows that and does not care or does not even know how bad things are.

    The other conclusion I have reached is that the hatred of Mike Cristo, and comments about him are always - always - spurious claims never, ever backed up with facts.

    So, as another commentor here has noted: We got it. Mike Cristo, in your minds, is the source of all evil. Got it. Got it. Got it.

    Doing something positive to improve Bruen will benefit ALL the people of our town. How about getting off of Mike Cristo and behind contributing to doing something positive about Bruen or any of the other serious and multitude issues facing our town and our citizens?

    2. (1)I like Mike Cristo and (2)I think it is important to recognize that the result of the intimidation is that Langley is now a big part of the McCabe branch of the democratic machine. Just look at Langley's behavior as shown by (1)the democratic political signs on his property during the last election and (2)his lack of support to any republican and conservative candidates last election and (3)his way of having Rick McCabe serve as the town's spokesman in the times union and (4)his attempt to ram through a gun control resolution through the town board that was fortunately blocked by Tom King and his supporters.

  37. I missed Langley's attempt to "ram through a gun control resolution through the town board". Why didn't anyone (Rep or Cons) realize what a phony this man is before he was nominated by the Rep and Cons to run for Super? I am not actively involved in politics. I depend on those who are to keep me informed.

    Before the last election, I was asked by quite a few friends what I thought of Langley. I told them what I had read on the blog and it was OK to vote for him. OH BOY, WAS I WRONG!!! Does anyone else feel they were fooled by Langley?

    You may ask why I don't get involved. I am too old and not well .It has been about three years since I started paying attention to EG politics. That occured because I did not like what the dems were doing to one brave woman who was trying to improve the town. She seemed to be on top of things. So much so that the dems tried everything to shut her up.

    Well, anyway, I want to thank those who are trying to help people like me. You are my only road to political knowledge of EG.

    4. The gun resolution was prepared by O'Brien et al but was headed for the usual 5-0 board approval that Langley has made the centerpiece of his service. The fix was in for this resolution until concerned citizens and politicans from the County and Schodack voiced their concern. We need more such concern on other issues and, lacking that, Langley, Matters and one Dem should just resign. Ginny and one other like minded individual could run the town without all the fuss and discussion.

The effort to do something about the gun incident reminds me of the furor that led to the noise ordinance, one of the worst local laws ever enacted since it actually raised the level of noise allowed by our zoning ordinance. In both cases there was a public outcry at a town board meeting and members of the board felt they had to produce a positive response. In both cases, the board deserved credit for wanting to do the right thing but sloppy drafts of a new local law doomed each effort to failure. The reason the gun law didn't go anywhere is because it caused another public outcry, this time by people who feared their second amendment rights might be abridged. The noise ordinance didn't have that kind of opposition so it sits on our books as a constant embarassment to the town.

    I think part of the problem is that members of the town board are only part-time public servants. Since they have families, jobs, careers, and all the normal social obligations it is too much to think they should be able to handle the full spectrum of issues that come before them. I think the lesson of the gun and noise ordinance fiascos is that part-time representation encourages micro-management by board members who often don't have the time to study the issue to the depth it requires. The constant flow of new issues before the board seems to ensure that no big-picture or long-term planning gets done and our town shows the strain of this lack of a strategic vision. We need a formal plan for financial recovery and a strategy for lowering the town tax burden in the very near future but the system isn't built to accomodate those needs and so far none of the five members of the current board have shown an inclination to break out of the micro-management cycle to focus on the big picture. To be fair, the micro-management model has recently yielded some positive results - the Couse Corner roundabout, the Hampton Manor Lake clean-up, the planning and financing of the waste water facility - but without strategic planning problems like junk bond status, the commercial exodus from 9 & 20, and most importantly, the obscenely high tax rate in town are not going to be solved any time soon. The key to an economic turnaround for East Greenbush is to change our reputation as a massively over-taxed town. Lower taxes would encourage businesses to come here, make it easier to buy and sell homes, and encourage the rating agencies to reconsider junk bond status. To do this would require tough decisions and strategic thinking and it would take a town government that puts the interests of the taxpayer ahead of the interests of cronies and political insiders.

  41. Jack, in part I very much want to agree with you. But I fear the part time town board members is far less the issue than their focus on themselves, their family members and their cronies. Those three considerations drive most issues. You got to see that first hand as the Chairperson of the Ethics Board.

    Then there is the simple reality that the town board, pretty much all 5 of them ignore taxpayers. Perfect examples are the CFAC and the Ethics Board. Both organizations exist pretty much in name only. As voices of the citizens of our town they are completely and totally mute.

    And last but not least is the reality that most laws are passed not for the benefit of taxpayers but rather for the benefit if a special interest or the politicians themselves. An example would be the no double dipping law. I would argue that if voters are okay with a person holding two elected positions the voters themselves have that right. It was okay for Ginny O'Brien until someone else did it. The no double dipping law was nothing more than an act of vengence directed toward Mike Cristo.

    Another example would be the no smoking in town park law. As a regular user of town park I can assure you that it is a law that is routinely violated and I am 100% certain there is not a single smoker quaking in fear of violating this so called law. But...Ginny got to add it to her "accomplishments". The noise ordinance you referenced is another example.

    The town board has a full spectrum of subject matter experts available to give it advice. I have lost track of how many specialized lawyers, engineers and other experts we, the taxpayers, pay to give advice to the town board.

    So, in sum, I think the QUALITY of who we elect matters far more than the quantity of the time the town board members put into doing the business of our town.

    As the only full time member of the Town Board, wouldn't it be appropriate for the Supervisor to at least initiate for discussion some "big-picture or long term planning" proposals? If he was willing to draw upon the expertise of people, both in and out of government, the Town could be well on the way to the establishment of "a formal plan for financial recovery and a strategy for lowering the town tax burden."
    What a positive, long-standing and collaborative legacy that would be!

But he should give it his best effort. I totally agree with the idea of collaborating with people in and out of government but there is such a distrust of information in our town. I agree with Ray Mooney's idea that CFAC and the Board of Ethics should have been used as independent sources of good ideas but that would require a trust that seems to be beyond the scope of the current board. We need good ideas and should be less concerned about who they come from than what they contain and how they can help.

    You have obviously lost any desire to work with people for a better East Greenbush and have reduced the bar of objectivity on this blog to an all time low.
    Are you aware that Phil Malone has just taken over the Democrat Committee in the Town Of East Greenbush? Are you aware that Phil Malone appointed his own family members as officers of that committee? Are you aware that Phil Malone appointed Joe Slater from the ethics board as his right hand person on the EG Democrat committee? Yes the same Joe Slater that helped develop an Ethics code that was shot down by Malone , O'Brien,& Mangold is now Phil's right hand guy.
    When are you going to wake up and recognize the real problem here? You have alienated yourself from the minority board who have their hands tied until the people give them one more vote.
    If you think you are paving the way to a better East Greenbush you couldn't be anymore wrong. All you are doing is empowering Phil Malone and his board majority, and they could care less what you think.
    Local politics is not the same as private business, and you have a lot to learn. All it takes is a willingness to understand before passing judgment. You are hurting the wrong people and its a shame you don't recognize it.

To this point, it has been intimidated and rolled over. Langley had the authority to present a budget with a tax cut and austerity measures which supported a financial recovery plan. He didn't do that. He could have put the onus on the Majority for the tax increase. He's the only one who can save his administration, and he's got 3 and a half years to do it, but he has to start getting advice from the people who know how to help.

Dear Wake Up (read Ed Gilbert), it is possible for Supervisor Langley to address civil service rules, draw experts together to form a fiscal plan, and ensure that the new money for the sewer plan remains free of corruption. He has refused to do his job and his political reality is that if he receives any endorsement he will pay for his failures at the polls. No one voted for Mr Langley to be a placeholder for two years. He and Mr. Matters get paid to speak out on controversial issues while they work with those on the other side of the isle to seek solutions. So, wake up Mr. Supervisor and do the job you are being paid to do.

      With a 3-2 vote voters, in the future elections, can understand what the majority and minority stands for, what the differences are. Where each party would take our town. A 3 to 2 vote encourages greater political discourse as each voting person is more likely to explain themself. A 3-2 vote gives people commenting on the state of our town something to talk about.

      And a 3 to 2 vote gives the minority party something, anything to campaign on in the next election.

      With a 5-0 vote we might as well elect people all of the same political party.

    "The Towns junk bond status and the debt was mostly reduced prior to the last election. But that FACT doesn't bode well with the Gadfly crowd. They want to take credit when they had NOTHING to do with it."

    The debt hasn't gone away. The reason we don't have the Toski audits for the last two years is that the records are so bad because of financial sloppyness in the past, that the various fund balances cannot be certified. The last administration owes taxpayers a lot, on a number of levels.

  54. I like the idea Joe Slater being involved. He is an officer of the court and if he is in on the secret 5-0 discussions maybe he can save the other Board Members from some of their foolishness (think ignoring audits, inter-fund borrowing, gun resolution, adherence to civil service rules). I have not voted for a dem for Town Board in more than 5 years but I might just support his candidacy to have a reasonable person in the room. Jack Conway is also a person who, if elected, could provide tempered and reasonable thought to the TB.

    What position does Mr Slater hold as an officer of the court? Is he an attorney, court clerk, bailiff, counselor, legal advisor or what?
    I have not voted for a dem in five years and still have no reason to start.
    What makes anyone think Mr Slater is different from Malone, O'Brien or Mangold? I am not being an obstinant voter, I truly would like to know the answers.

  57. Seeing my name mentioned and realizing that many people don't know who I am, I thought I would just take a moment and introduce myself. I am a Columbia High School, University at Albany, and Albany Law School graduate. In December of 2010, I heard that an Ethics Board for East Grenbush had been formed and they were in the process of drafting an updated ethics code. Having recently completed my education at Albany Law, which included courses in government ethics, I asked to be appointed to help draft this new code. I believe we did a terrific job in drafting a code, but unfortunately it did not pass.
    In 2012, I was appointed to be the Attorney for the Planning Board, and subsequently, when Mary Pat Donnelly became Town Justice, I became attorney for the Zoning board, filling her spot. In this role I advise the board on the legal aspects of applications that come before the board, but have no say in what the board ultimately decides.
    Recently, I resigned as a member of the Ethics Board and accepted a position as Vice Chair of the Democratic Party. I resigned from the ethics board because our draft code prohibited ethics board members from holding a position with a political party.
    I have never let my party affiliation affect my decisionmaking as a volunteer and/or consultant for the town, and I think the others whom I worked with on the Board of Ethics would attest to that.
    I still hope to see an updated ethics code passed in the near future. I'll see you all around town.

    No meetings have been held, minutes have not been posted in months. There is a pending complaint, filed under the 1974 version of an ethics code, than remains in abeyance.

    The draft ethics code you supported was super. Perhaps you can enlighten the readers of this blog as to why your political mentor, Phil Malone, refused to support it and voted against it?

    Share what you can and your credibility will be enhanced. Play political word games or decline to respond and it will not. Pretty simple.

    1. I cannot speak for individuals. Ultimately, the Town Board did not agree with the financial disclosure portions of the code. As a board, we had an internal agreement to not discuss specifics of the code with our appointees, but would communicate messages collectively as a board. For me, it was personally and professionally a dissapointment. One which I hope will be rectified in the near future.

  60. Venting - with a point...

    In my neighborhood is a retired East Greenbush fire department chief. For years he had the personal use of one of our many $60,000 Chevy Tahoes.

    His son took over the chief's role, with the vehicle - of course.

    On this gentleman's front lawn is a fire hydrant.

    And in all the years he, and his son, have been a chief and driven that nice vehicle, has he never, even once, removed the snow from around that hydrant.

    This kind of "leadership" is exactly, in my humble opinion, what is wrong with East Greenbush. By the way, does anyone have an update on the $25,000 theft investigation by another chief from one of our fire districts?

      #2) the "thief" still walks around with his head held high. He currently is still employed by our Police Department - thanks to Chief Lavin !
      #3) if your venting about the "chiefs vehicles" , your way too late ! These spoiled volunteers use these vehicles for way too many errands and chores not related to Fire Department business, and guess who foots the gasoline bill? Yup- the taxpayer of East Greenbush !

    In all the years I have lived here I have NEVER seen the water dept. out removing snow from around fire hydrants.

    It occurs to me that, when the hydrant is on a home owner's lawn, the homeowner, as perhaps nothing more than a gesture of good citizenship, should remove the snow around the hydrant.

    Can you share the name of the fire chief involved in the missing $25,000? More needs to be made of this issue - including, but not limited to, how easy it is to misappropriate funds when there are no substantial or meaningful audits.

    The fire department theft by former chief DiMartino is being covered up. He remains a cop. Imagine that? Just try to imagine that?

  63. I am always shocked by the practice of nepotism by elected officials because when it's discovered people usually react badly by it. Only those who benefit by it are okay with it. In ANY hiring situation, responisible employers will search for as long as it takes for the best, most qualified candidate for the job. Only irresponsible, self-serving town board members will take advantage of their "majority" status on the board and vote "yes" to appointing their family members to town jobs. It looks and smells bad. As a tax-payer, I resent having to pay taxes to pay for an elected officials husband, wife, daughter, etc. to jump on the payroll. It shouldn't be allowed, it's just wrong. If we had any sort of a decent ETHICS LAW with TEETH, it wouldn't be allowed. Now we all know WHY we don't have a strong ethics law. Need I say more?

    Consider the cost of health benefits and state retirement pension credits?

    Where would Ginny O'Brien get health benefits if it was not for her husband's appointment as data collector?

    Benefits covering the appointing town official is really and truly the "hook" for these nepotism appointments. And it is an outrage perpetrated on taxpayers. Sure, we are also paying the salary. But the cost of health benefits and state retirement pension credits is HUGE and getting worse every year.

    And you are absolutely correct about the ethics code. Read former chairperson Jack Conway's OUTSTANDING letter to the town board when he tendered his resignation. Jack Conway is a good and decent man. He, and the Ethics Board, worked long and hard on an ethics code. But, as you correctly point out, that ethics code threatened the "crap" we call nepotism but someone prone to being nasty might call nothing more than legalized theft.

Look at what they have accomplished in only one year of working together. No new people are needed. Keith and the Town Board have earned our support and respect.     1. I like Langley at 3:22 p.m., you are completely freaking dilusional! The "majority town board" consists of three people: Malone, O'Brien, and Mangold (affectionately referred to as MOM). If you think for a second that it's a 5-0 board or that MOM would ever share the credit for any "good work" they are doing with the Supervisor, think again. Langley and Matters are doing the best they can under some extremely difficult circumstances but make no mistake about it, they are very much in the minority. And please provide us with a list of "all the great things that are happening" in EG. In fact, I challange you to name three GREAT things that are happening under the current majority. And exactly what have they accomplished in only one year of "working together?" Please BE specific. OMG! I think you need to wake up from your dream state and take a whiff of reality in EG. I can tell you right now that it STINKS!

We'll see what kind of "character" gets exhibited by your wonderful collection of politicians when it come time to move on the recoupment of the stipends, etc. What do you bet they try to avoid going after "Party mates and Committee mates?"     Pray, tell us what Langley has accomplished.

    His appointments have been a total disaster. He could not have mishandled the Ingoldsby firing any worse. There is no financial plan.

    He has failed to challenge the majority in any meaningful way.

    Open government has taken a huge step backwards.

    So, please, please provide us with facts (and not spin) on what Langley has accomplished. All of us who voted for him expected things to be different and different better. If there is evidence of that please provide those facts.

You are correct Anonymous 4:15 p.m. Plus, Langley had a huge supportive base when he first got elected who he single-handedly managed to completely alienate because of his paranoia, superiority complex, and lack of people skills. He had no abilty to rally his base, appreciate them profusely, and keep them motivated. Now, they're pretty much scattered and gone. Very disappointing. And he really has no power to "challenge the majority" because he's pretty much alone. I think he's still better than McCabe but, at this point, not much. I ask you, where's the improvement?

McCabe would love to save face by becoming relevant again but it's not going to happen. Please, show us PROOF that he is what you claim he is. You can't because he isn't. These are all just rumors, including that they are "good buddies." Rumors, nothing more.

  71. To 3:35PM. The Supe is planning to put the resolution to the OSC report on the 2/13 TB agenda at 7PM. Go to the meeting and watch the Supe lead the way to get the stipend money back. If you can't be at the meeting stop by town hall before lunch and talk to him. He will tell you what he is thinking.

  74. I don't understand the criticism of Keith Langley for becoming part of the TB majority? They have accomplished a great deal for the town in the last year, including the sewer project, the hampton lake cleanup, the recapturing of the scrap metal monies and the appointment of a terrific town justice. These accomplishments just don't happen they take strong leadership. Keep up the good work Keith.

    1. Dear Anony.....It's been a long Winter for this blogger, but some stuff is in the works. I think we need to concentrate on the Board's handling (or to this point, non-handling) of the recent OSC audit report. There are some things in there which they really want to go away. You know.....the financial practices which got the Town is such trouble deserve some examination. And patronage and nepotism (the header for this thread) haven't been curtailed at all, have they. Same old, same old...with the "new guy" supposedly running things.

      Where's the Ethics issue?

      Where's the Financial Recovery Plan?

      Where's the Bond rating progress?

      Any plans for 9/20?

      What about an audit of Bruen?

      ETC.......

    2. Gadfly, I'm glad you are focusing on the "Board" as a whole and are not being fooled by the self serving protestations that there is a BAD 3 member Majority Board aimed at preventing the GOOD 2 member Minority from creating a paradise on earth here in EG.

      The people of EG able to attend tomorrow night's "Board" meeting will see first hand some strong cooperative leadership by the Supervisor and the other councilpersons.

      The Langley "Board" will do the right thing with a far reaching and public response to the OSC audit.

    3. Frankly Anony, I'll believe it when I see it regarding the "right thing" with a response to the OSC audit. If I recall correctly, we heard from Ed Gilbert (when he was TU blogging for the Supervisor) that there would be a very accommodating and "kind" response to the stipend recoupment recommendations in the OSC report. What I took from the Gilbert comments was that there would be no recoupment - and Gilbert has been the only one out there with any policy articulation until he stopped.

  78. I want to know why the town board has no public plans for doing anything about the continuing decline of Columbia Turnpike?

    I cannot recall even hearing any concerns expressed about it.

    And I really, really want to know why the Harts and Sue Mangold as a part owner of Hart LLC have left the old motel partially torn down and looking like the absolute dump it looks like.

    How about it Ms. Mangold? If you, and your family, care at all about our town how about doing something about that dump.

    You got your tax certiori reduction. And you left it looking like the worst dump around town.

  80. Most of Columbia Turnpike is owned by the Witbeck and Hart families. Exactly which family owns which parcel would need additional research.

    The partially torn down motel has the excavator parked on it. Take a cruise down Columbia Turnpike - you cannot miss it.

    The Hart family is believed to have destroyed the motel buldings to support their property tax appeal - which like all commercial tax certiori cases around here was successful.

  87. I laughed when I first heard about Keith Langley offering a job to his democratic opponent, Rick McCabe! A short time later I found that Langley did,indeed, offer the Deputy Supervisor position to Rick. By doing so, he would have happily squeezed out his close friend Ed Gilbert (the guy who signed his political death certificate by running on the conservative line against the current State Senator Marchione). McCabe refused Langley and Gilbert is still responding to Langley's every whim.
    So, now we are hearing that Mr. Langley wants to run for the county legislature. Sounds crazy to me again but it seems that Mr. Langley is the lead actor in our own little East Greenbush Theater of the Absurd.
    4:35 - I think the deal would be that she runs and Mike stays
    6:03 - Mr. Matters should stop thinking and start doing

All he has the power to do is think, and he can think all he wants but unless the majority supports what he thinks, and they DON'T, we're ALL outta luck. If Mr. Matters was the King of East Greenbush, what a wonderful town this would be because everything would be done properly, ethically and fairly according to the law. Imagine that? Properly, ethically, and fairly...oh,my! Sadly, he was never given a chance to make a difference except for like five minutes when Phil Danaher and Mike Cristo were on the Board. But then they left, just up and abandoned their posts, leaving Mr. Matters (and the town of EG) high and dry. Yes, Mr. Matters is a thinker, not a stinker. Imagine that.

  89. Dear Wake Up.....This is East Greenbush. What you read here and on that "other" blog are products of the folks who drink the water around here. Remember, this berg has quite a reputation. Take a look at the Link to the TU story at the top of this page. The antics of our politicians is legendary, and the "fix" is so far "in" that we can't get decent outside oversight and control. Doesn't it look like that the cronies at Town Hall are going to allow their buddies to walk away with almost $200,000 of illegally taken cash? Where else do you see that happening?

  90. Sorry, but we are "special" here in East Greenbush. We somehow avoid referral to law enforcement for similar activities. The "choice" is left to the Board to consult an attorney to recover illegal payments in our case. In Saratoga a couple of years back, the poor woman who took money (really small change, by comparison) from the trash bag fund got an appointment with the DA on recommendation of OSC. The OSC even edited, revised and reinterpreted the "taxpayer complaints" before addressing a couple of them in the recent report. In one instance, they left out the central issue in the complaint.

  91. The Ethics Board posted last posted meeting minutes on March 2, 2011. For those of you keeping score that's coming up on two full years!

    The Citizens Fiscal Advisory Committee last posted meeting minutes on July 9, 2012.

    That must mean something. What does it mean?

    Could it possibility mean that neither citizens group has any use or value to our town board?

    If that's the case that is a fascinating thing because if there is one thing our town has plenty of it is problems.

    Every audit, every credit rating agency says the same thing.

    Columbia Turnpike looks more and more like a slum every day.

    And the town board is saying nothing and doing less about any of these things.

    Heck, at the rate things are going we will have more waste
    treatment capacity than we need and no one around to pay the bond!

    Oh wait, I know...we'll attract more business. Drat it all that won't really help because we only make small businesses and homeowners pay taxes. The big businesses either get tax breaks or tax certiori appeals approved.

    Come on town board. We need vision, leadership, communication and action.

    1. 2:09 PM What we need is concerned, responsible residents who will research the education and experience that candidates running for the Town Board have to offer BEFORE they vote. For example, Phil Malone installs solar panels for a living. There's nothing wrong with that, it's good, hard work, but what are his qualifications to serve on the Town Board and make decisions that effect the whole town? One might also ask the same question of the rest of the board members. Are they there because they are truly QUALIFIED to make decisions on behalf of the residents or just because they managed to get the most votes? How many people pull the lever for candidates they know nothing about? Probably A LOT. But think about the power you are giving someone, possibly someone completely unqualified to serve on the TB, to make decisions that will ultimately effect the quality of your life. The same thing is true of candidates for the school board. Voting is truly an enormous responsibility. The wrong choices could cost us BIG. That's why candidates need to be researched and effectively "cleared" to represent others. It's hard work but it's well worth the time in the long run.
