The Big Picture - By Publius

Reader Publius has submitted the following remarks to the Gadfly Blog.  I think they deserve a Post Thread of their own:

As a reader of all four East Greenbush Blogs I would like to take this opportunity to make a few observations that may be helpful to East Greenbush residents from both sides of the aisle as well as the reformers.

First, there have been several posts about one side or the other being politically motivated by only criticizing their opposing politicians in relationship to inappropriate distribution of public funds. They are often paired with the observation that those who approved the appropriations are not those are currently serving in town government. They are incorrect. The most recent misappropriation of funds to an elected official was proposed and approved by the current Town Board. Resolution 165-2012 presented on November 14, 2012 provided for the $1,000 per year formerly paid to Town Supervisors in the form of “sick leave” payments be changed to regular salary to make the payments come into compliance with the OSC audit. The fact behind the obfuscating language in the resolution was that the audit found such payments to be wrong and our town officials devised a plan to “get around” the audit finding and still get the funding to the Town Supervisor. In this case, a citizen at the Board Meeting pointed out the inconsistency in the thinking surrounding the resolution and, as a result, the Town Attorney subsequently directed the Supervisor to return the $750 already illegally paid as his “sick leave incentive” in 2012.

The citizen in question was criticized in the TU Blog by the Deputy Supervisor who used all the tricks typical of those who discourage public participation in government. He implied that the citizen was unable to understand the situation, he was dismissive, and he alleged political motivation. The fact that the money was repaid and did not reappear in the 2013 budget proves the Deputy Supervisor wrong.

In the big picture, however, this event illustrates that the mechanism and the inclination to hide payments from the public exists in this Town Government! Our town leaders devised this plan during the same time period that they were (or should have been) digesting the audit and developing a plan for corrective action. We cannot continue to elect the ill-prepared and uninformed to public office and expect good government or ethical behavior. We must prevail upon both political parties to nominate candidates who are well prepared, beyond reproach ethically, and able to withstand the fallout that making hard choices brings. The person who appears at your door every year with nominating petitions is your representative in the party of your choice. Contact that person now, before the candidates for the fall are chosen, and ask them to find candidates who are experienced in government, prepared to do the work, and are of high moral and ethical character.

Resolution 165-2012 was proposed by Mr. Malone and seconded by Ms. O’Brien and passed by a 5-0 vote. Although the amount was small, the idea is flawed and, just like the stipends of old, the wrong minded public official has the potential to do much damage. Beware of the candidates who are endorsed by today’s sitting Town Board.

My second concern is the often used “interfering with the audit”. It is not challenged when it is used and it should be. Concerned citizens who contacted the OSC are exercising their responsibility as citizens in a representative form of government. The employees of the OSC and the town are the employees of the public. It is in very bad form for bloggers to regularly refer to citizen activists as interfering and not be called on it. The audit has unveiled wrongful acts and this disparaging language is one of the tools of those who are actively working against a meaningful corrective action plan. I urge citizens to support those who, like the Gadfly, ask hard questions and support meaningful reform.

    Thanks for posting. The really troubling point I take from your article is that this is the same crowd responsible for the administration of the up to $14 millions sewer bond debt. Let's hope concerned taxpayers like the Gadfly continue to remain involved and inquisitive every step of the way.

  2. Dear Anonymous....There is a reason that I put up the two links to the ballot fraud case just up on the right. The small town mayor is a "big" player in it. And when the sewer process did a 180 after all the investment and study on the alternative, some of us perked up. East Greenbush (as I understand it) already has an FBI file. There certainly doesn't seem to be much interest in getting the taxpayer's money back - as recommended by OSC. But here are some interesting facts:

    The General Fund/Highway tax increase this year is about $99,000. Add the special districts, and the tax increase is about $323,000. The OSC stipend recoupment amounts to $102,000, and when you add the sick-leave/longevity recoupment of $39,000 you have $141,000. That's half again as much as the General Fund/Highway increase and close to half of the all-funds tax increase.

    There are a couple of lessons here. First, throwing taxpayer money around to a select few as "benneys" for the insiders costs tax increases for the rest of us. Second, as Publius points out, the current bunch doesn't seem to have any sensitivity to these issues. They were real quick to take care of Langley, and they haven't shown any interest in recoupment - yet. I would think a resolution on recoupment offered by Langley/Matters would be appropriate. It would provide an opportunity to separate the sheep from the goats. No resolution.....they're all goats, and both Langley and Matters have rolled over to the Machine.

Just a quick addendum......the material in the OSC audit related to the sick-leave and longevity payments to the Supervisor and the Receiver of Taxes was NOT included in any of the taxpayer complaints sent to the OSC (to my knowledge). These issues were surfaced (as OSC says) by OSC in the OSC review of the stipend complaints.

  4. I just read the link "Hatching the Ballot Plot." It really shows the strong need for taxpayer scrutiny and oversight in local government operations. Nice work by the FBI in uncovering what was going on!! Too bad it had to get to that point.

    2. Yes....Kinda puts the desire to NOT have financial disclosure out there in a more understandable light, doesn't it??? Anybody who thinks EG is unique and doesn't have the problems illustrated in what is "breaking news" downstate, is just plain crazy. It's the stuff of what goes on in politics on all levels. Constant vigilance is the only thing that will protect the common taxpayer.

      Even the oversight agencies have their weak moments. After all, Dinapoli signed that $103,000 check to pay off the sexual harassment victims of Vito Lopez - at the request of Shelly Silver.

    1. It is my understanding that Fed law enforcement was in Town some time ago looking into the disbursement of some FEMA money. Those closer to the matter may want to comment.

  8. I want to point out that there were 56 concerned citizens who signed the letter that went to the OSC prior to the most recent audit.

    The facts and documents furnished to the OSC remain unchallenged. True the Talks bloggers have made fun of people and engaged in everything except a fact based rebuttal but that's no surprise. The facts, and supporting documents to the tune of hundreds of pages were, and remain, facts.

    It remains everything except political to understand why the town board is not advancing the effort to recoup the large amount of money improperly paid to politically connected town officials, family members and friends. We are not talking chump change here.

    You know when a politician falsifies an expense report and is held to account for it there is no difference with what was done with the stipends or the sick leave or the longevity pay. Proper procedures were skipped and money was given under extremely dubious circumstances. Seriously, how can anyone not challenge the supervisor awarding money to himself and his daughter?

    The thought that this town board is going to miss manage some $ 14 million of our money is frightening. Jim Breig was our last, and for the time being, best hope for some fiscal sanity with this project.

Also please refer me to the quote where I implied "the citizen was unable to understand the situation" I am confident you can answer these request and once I have a better grasp of exactly what we are talking about I will be happy to answer your statements more fully.   10. Ed, with all due respect you have decided to become the Joe LaMontaine (not sure I spelled the name properly) of the non majority party.

    More bluntly, and less respectfully, you have become a shill for the supervisor.

    We all get that you are advancing your own political ambitions, courting favor, lining up support, playing a role and all the rest. There is most certainly nothing wrong with all that.

    In the process you may have lost some credibility with non political types but I am sure you weighed that risk as you changed your personal approach as well as your public verbal and written comments on town issues.

    But...you are a politician now. And, for whatever it might be worth (not much I am certain) acknowledging what you are and what you seek would be a nice thing to do.

  11. Thanks to all who pointed me In the right direction. My previous blog in November 2012 I took Tom Grant to task for Mischaracterizing the supervisors salary as a raise I stand by that I also said that tihe accusations were politically motivated I stand by that as well. Now onto the new stuff. First let me say I had to laugh when I read "with all due respect" Followed by accusations that I am shill for the supervisor and am advancing my own political agenda. Nice. Pubius you are incorrect that the supervisor repaid the incentive he actually declined it .how money that was never paid would show up on the 2013 budget as repaid is a head scratcher.     Facts are stubborn things...

    Fact, the Supervisor repaid $750 in unauthorized sick leave incentives he received for the year 2012.

    Fact, Resolution 165-2012, moved by O'Brien and seconded by Malone, was a last gasp attempt by the Board to legitimize the unauthorized sick leave incentive payments as a salary increase (raise) for the 2012 calender year.

    Fact, Resolution 165-2012, had nothing to do with the 2013 Budget.

    Fact, the 2013 budget discontinued the unauthorized sick leave incentive payments to full time elected officials, as mandated by the OSC Audit.

    1. The Town Clerk and the Town Receiver of Taxes also repaid the unauthorized sick leave incentives, at $1,000 apiece, they had received in 2012.
      As part of the 2013 Budget that RAISED TAXES for EG residents, the Town Board INCREASED THE SALARIES for the Town Clerk and the Town Receiver of Taxes.

      Councilperson Rick Matters was the only member of the Town Board to vote against these Budget shenanigans. Langley, O'Brien, Mangold and Malone voted in favor of the salary increases.

      It gets even better---

      The "official" Town Board authorization for the 2013 salary increase for the Town Clerk and the Town Receiver of Taxes took place at the December the 19th TB meeting via Resolution 177-2012 which was passed by a 5-0 vote as Local Law #4 of 2012.

      Wait for it--- the motion to approve those salary increases was made by Supervisor Langley and was seconded by Councilperson Matters.

    4. Anon 2:25. Mr. Matters did not vote against the resolution that laid the groundwork to slip the extra $1,000 to Mr. Langley. Sadly, he, like all the others voted for it. He did vote against the budget but he did so after the "sick leave raise" was removed.

  13. It never seeks to amaze me the creative ways politicians find to transfer taxpayers' hard earned money to themselves, their family memmbers and their friends.

    Stipends, sick leave incentive, longevity, and consulting fees are examples employed by our town officials to semi legally to illegally to now quasi legally take our money for themselves.

    Hopefully we'll all wise up come November's elections.

    You are certainly free to “stand by” your opinion that the change from $70,000 to $71,000 in the supervisor’s salary is not a raise; my essay asserts that money characterized as “sick leave incentive” but raising the 2012 salary IS a raise. The payback indicates that Mr. Grant and others hold a valid opinion in this matter and that there was no mischaracterization.

    Please be aware that the Times Union allows you the privilege stating your opinions in their blog and it seems that many readers enjoy reading your opinions. This privilege does not, however, give you license to “take to task” any citizen. I googled your phrase and found that the definition implies a teacher student relationship where the teacher admonishes the student. While your readers may welcome your opinions, you have no authority to scold people who are stating their opinions. Your decision to “stand by” the accusation that Mr. Grant’s curiosity was politically motivated is an opinion, not a fact. My essay merely points out that you were quick to make such an accusation in an effort to cover and confuse the basic issue: these payment were inappropriate.

    Whether the supervisor “declined” the 2013 sick leave incentive or it was a directive from a higher authority will remain unknown to all but the supervisor and the powers that be but, the fact remains, the payment was in the budget before Mr. Grant brought it up and was removed after his comments provoked your blog on the matter.

  15. A funny thing about this whole dialogue is that Langley's attendance is abysmal. Even if the payments were appropriate, is the Town in the habit of giving these payments to folks with a work ethic like Langley's?

  16. The problems discussed in this post and thread stem from an obsolete political culture. It doesn't matter if democrats or republicans hold the majority on the town board because they will both do the same thing - take care of political insiders, family and friends at the expense of taxpayers and to the detriment of good government. It's hard to blame individuals because as Rick McCabe once famously (and honestly) said - "This is how it's always been done." Regardless of which party they support, people who run campaigns and candidates who run for office have similar expectations about what's at stake and what jobs and contracts they will control if they win.

    This system worked for towns like ours until the context of local government changed and the economy worsened. Local government now requires a more technical and professional approach using generally accepted accounting principles, a streamlined work force and more efficient delivery of basic services. With the amount of state and federal taxes we now pay it is critical that the cost of local government be reduced to manageable levels. Recent audits have shown how far we are from making this transition. Our town government is using a 20th century model to solve 21st century problems and it's not working. If you think I'm wrong take out your most recent tax bill.

    The reason I got involved with the Board of Ethics is that the drafting of a new Code of Ethics is a rare opportunity to change the template of our political culture. The old system is built on cronyism and patronage and these practices are protected by a lack of open and accountable government. They depend on having information that is only known by insiders. Knowledge is power. They also depend on the apathy of citizens and unfortunately the good folks of East Greenbush seem happy to oblige. A strong Code of Ethics requires accessibility and accountabiliy from town officials and protects people who want to make a difference by insisting on fairness and an end to favoritism and insider trading. Nowhere was the current town board's resistance to necessary change more apparent than in their refusal to pass the draft Code of Ethics proposed by the Board of Ethics. If people want to make real changes in the way we are governed they need to press our elected officials to pass a strong Code of Ethics. Until we change the political culture it really doesn't even matter who wins elections unless you are looking for a job or contract with the town.

      I'm sure he will be shortly appointing a dynamic and highly ethical individual to the Ethics Board to take Jim Breig's place as the Supervisor's appointment to the Ethics Board.

      I wouldn't be surprised if he doesn't plan to meet with Jack Conway to get his views about the future of the Ethics Board.

      Keith is the type of leader who enjoys reaching out to people to get the information needed to make thoughtful decisions.

      We are very fortunate to have Keith Langley as our Supervisor.

  17. One of the expressions used by the OSC in describing how compensation is set for elected officials is: "it is well established" - meaning the proper procedures to be followed.

    Not in East Greenbush! So we had highly experienced elected officials like Rick McCabe and Ginny O'Brien and a on staff town attorney in Joe Liccardi who either did not know (highly unlikely) or who knew but never expected to get caught (much more likely) screwing around with our money and giving themselves, family members and friends stipends and other improper forms of compensation.

    The OSC recommended that the town board explore getting that huge amount of money improperly paid back. The current town board, so far, has done what they are best at - NOTHING.

    If that somes across as harsh keep in mind that it took 6 consent decrees before the town board was forced to address the waste treatment issue.

    Responsibile, ethical, sound leadership? Not around here - not yet anyway.

  18. Your comment is right on the money, Jack. The only thing I'd add to the concept of inertia is the fact that there are those "fat cats" behind the scenes who also benefit from the status quo and do a lot of the "shot calling." I did hear that two or three of these boys had lunch with Mr. Langley early on to "fill him in" on how he might be "successful." Maybe this is why he abandoned so quickly what many of us thought would be a reform agenda.

    I'm of the opinion that the people who perpetuate the things you outline really need to go. The mindset is un-reformable. The excuses are still being made, and the shenanigan with the recent salary "additions/replacements" which Publius highlights is an example of how pervasive the problem is. All of this fits right in with what is being revealed of the "culture" statewide. East Greenbush fits right in with the Senate/Assembly stuff.

    The only way to progress forward is to delete these power hungry fools of the past and send them a clear message in November.

    We can all claim to dislike the decisions of Phil, Ginny and Sue, but you would be completely remiss to not acknowledge of antics and mischief of Defruscio, Cristo, and the rest of the fools on the Republican side of the aisle. Those two specifically have dragged down the Republican party to nothing more than a cheap bar-room joke.

That comment is pretty angry and irrational, and is received as such - since my name is the one mentioned. I will say it's too bad the State Comptroller didn't have the guts to make a referral.

  23. Jack, please please run for town board. I have never met you, but if 3 people such as yourself were ever on the board I know that things would be done right. I would beat the pavement for you and help out your campaign regardless of which side you were on, even if it was your own side and not one of the major party's.

  25. What do you say, Boys and Girls? In line with what Jim C. says, is it possible to put together a ticket for the next election which is not aligned or beholden to either "Machine" and free to do good government for all of us? They'd probably have to function as a "minority" for a couple of years, but make a record of what would be possible when the Town would be rid of the Machine control. Jack's right about the current culture belonging to the last century. We have a chance to make a change.

    1. It is very possible.

      The way to start is to begin a strong public focus on the two major party leaders: Democratic Chairman, Phil Malone and Republican Chairman,Chris Defruscio.

      Attend their Party Committee meetings, ask them what their personal positions are on issues such as a financial recovery plan, a Town Ethics Board, sewer money oversight...

      Get a sense of what their views are on the future of the Town etc.

      A public focus on the two party leaders might empower the currently ignored Party rank and file to begin to ask some questions and call for some alternative viewpoints to be considered in Party deliberations.

      If these viewpoints of the rank and file are ignored or dismissed by the two EG major Party Chairmen, you would then have the makings of a third party movement in EG.

      Genesis.....Pretty sad commentary on Town government then isn't it? These two (the Party Chairs, whoever they are), in effect, run the Town. No wonder we are in the pickle we are in. Yikes!! Just think of the brain trust they bring to the task. Party "hacks" are going to make government/tax policy unless the people take back the government.

      Just like across the river. Once the "disease" gets established, it takes a lot of effort to get rid of it. But it won't happen at all unless we make an effort.

      Of course the commonsense and simplest scenario would be that the respective Party Chairs and their two Committees determine it would be in the best interests of BOTH their Party AND the Town to nominate and actively support candidates who believe in open government and prudent fiscal management.

    Mr. Gilbert what is your position, and what do you recommend to the Supervisor and Town Board, on the OSC's recommendation that our town seek a legal review of getting the stipend and other improperly awarded tax money returned?

    Do you agree or disagree that the recent resolution to grant elected officials like the Supervisor and Tax Collector more of our tax dollars via sick leave incentives and longevity pay increases was a good thing to do?

    1. No. The money for 2012 was returned because they were caught trying to get the sick leave money with a slick resolution after they had an audit saying it was inappropriate. There are many prior years for which the no money was recovered. The OSC suggests that the Town go after the money but no sign of that yet.

  29. There is a saying among homicide cops:

    "Everybody counts or nobody counts."

    Around here the exact opposite is true. Around here George Orwell's line from one of his book is most appropriate:

    "All animals are equal; some animals are more equal than others."

    Both quotes show us why people like former judge Shilling thought it was okay to fix tickets. These quotes show us why the former supervisor thought it was okay to give himself, his daughter and his friends taxpayers' money. It fully explains why jobs go to only family members and friends instead of to the most qualified.

    Around here the only thing that counts is political connections.

    And that's precisely and exactly what is wrong with our town.

    The single exception has been Rick Matters. All the other politicians from both political parties operate, as Jack Conway so well stated, exactly the same. They are in it only for what benefits they can take for themselves and their families.

    That's what keeps Mike O'Brien, Joan Malone and many, many others - from both political parties mind you partisan fanatics, in jobs that provide nothing to the benefit of taxpayers.

    It is too soon to tell if voters have had enough. We'll get a better read on it in a few months.

    1. Anon 8:52. I disagree regarding Matters. His silence is his acquisance. He did not support any candidate in the last two election cycles and he votedfor the raises for elected officials. The only meaningful thing he has done in three years is champion ethics.

  32. Mr. Gilbert: somewhere along the line you got accused of being a front man or something or another for the supervisor.

    I noticed that you are avoiding a simple but I guess politically tough question about taxpayers getting their stipend and other improperly given away money back.

    Did you notice the sentence by the author of this article about leaders making tough decision and choices? If you missed it how about re-reading it?

    Our town desperately needs a new vision and leaders who will deliver that new vision. Can you be one of those leaders come this November? Not in my world if you keep ducking simple questions like what was asked just up above.

  37. There has to be someone better than Defruscio ! There just has to be. Opinions on the former Town Board member certainly vary. You may like him, feel free to vote for him. I personally think he was a bad decision for Town Board. He did absolutely nothing while he was on the board. He has no accomplishments to his credit. As far as his honesty and integrity - that is clearly in the eye of the beholder !
    He was the liason to the DPW and never walked thru the door of the Town Garage. The scrap apparently went missing on his watch. That fact combined with his apparent demolition experience and familiarity with the scrap industry leads to many unanswered questions. Defruscio had no clue either.
    He allowed Defruscio, his best friend, to literally run wild , a man who had zero experience as a supervisor , let alone any real word experience to lead the DPW.
    You may disagree with me, but you asked me. That is my response. Perfection again, is in the eye of the beholder.

    In case you haven't figured it out yet, Genesis, the Dem Machine runs this Town. Little can be accomplished without the permission of the Boss. There are connections which run to the Albany Machine and the Assembly and the Gov. (Take a look at who has friends where. And who shows up at golf outings.) Mr. Matters is a single voice, but nobody is all over him for not introducing the second coming of Jesus Christ. Why is all the heat on Cristo for not bringing on the Millenium? Minorities can only do so much, and there is a strategy (which Langley hasn't learned yet) which must be followed.

The dollar bills are dripping from their chins. Machines suck money from the public, no matter which political stripe. Look at the Town Hall roster. Look at what the current Board did to re-direct illegal money to the Supe and Receiver into "legal" money with the Resolution mentioned above. And we get the tax increase to fund it and the pensions that go with it.

  42. Genesis is not off base. Christo put his friend in charge of DPW which is the crown jewel of town jobs. He is just as guilty of nepotism as anyone else. Genesis raised other valid points and for us to ignore them makes this side as guilty of ignorance as the other side.
    a more important point is, who cares? The guy isn't involved in town anymore. He isn't on the board or a candidate so who cares? Why do they keep beating the dead horse with Christo and Tailor? Attacking the inconsequential is a waste of time.

    1. anon 12:13: You just restated one of the original points of the article on this thread - both of the current major parties are pretty much the same and not in a good way. You lost me at: with this or that person gone, who cares. We should all care because the mechanism to do the same bad acts over again still exists. The holes were never patched, there are no internal controls, no appropriate ethics law, no leadership and none on the horizon.

Jack Conway can correct me if I'm wrong, but I think one of the central requirements which is in most local government ethics laws is that NO political party committee member may be a Town officers or appointed employee - or some such permutation. This is supposed to protect the governmental mechanisms from being "bought and paid for" arms of local political parties. What have we got? The Chair and Secretary of the Dem Committee are Board member and Town Attorney Secretary respectively. A while back, I think the Finance Officer and Comptroller were on the list. This cuts both ways for both parties, by the way.

    $14 million bucks is a lot to be able to spend without some reasonably independent internal controls in place. Recent history supports that conclusion.

  47. Our town has quite a recent history with DPW Commissioners. Pete Partak is the guy who, on his watch, "lost" the gas records and wiped the department's computer hard drive clean. Ever wonder why that might have happened?

    DeFruscio has not in office very long. He had a harassment charge brought against him and the town (meaning we taxpayers) bought him off with a financial settlement.

    VanWormer was fired as a cop for sleeping on the job and using the town of Rensselaer's computer for personal business. His bar was fined for serving under age people.

    That, taxpayers are the people our town boards put in the highly responsible position of head of our DPW. Are you full of confidence yet in the town board's other decisions?

    Ginny O'Brien's husband is collecting money from taxpayers. So, too is Phil Malone's mother. Is your confidence in our town board growing?

    Keep all this in mind. This same cast of characters is a out to oversee about $14 million of our money on the waste treatment plant. Taxpayers should NOT feel good about the ability of our town board to handle that responsibility any better than all these other sad examples.

  49. Publius---It seems there has been a misunderstanding and it is my fault. When I wrote who cares it was meant as in, why continue to malign Christo & Tailor. They are not running and do not serve on the board, heck, Tailor never served. Why continue to attack them? To attack the acts of the past boards I understand but why continue to attack the individuals that are not and certainly individuals that have never served. If we want to get technical, Tailor who never served did more to uncover the mischief in this town than any of those that did serve and were paid for their service. To continue to attack people who no longer run or are involved, especially personally attack them. My belief is we should learn and know the history and know those who served well and those who served themselves from there we study the acts of those currently serving and those running and compare their acts and ideas to those in the past that didn't work. But who cares about the people that have dropped out of the political game? Why keep attacking them if they are no longer involved?
    Hopefully, this clear up any misunderstanding.

  53. Its real simple - if there's a current deficiency or lack of workers that would result in others working overtime, its always cheaper to supplement the workforce rather than fork over premium pay to "senior" workers. If they need to hire to get the work done, so be it.

    You obviously know nothing about hiring and the expenses associated with adding staff.

    There is a balance point where overtime is actually far less costly than the staggering cost of benefits - health care and pension. Those costs are roughly double the wages paid. Some overtime can be justified given these staggering benefits costs.

    Adding staff, when it comes to the combined cost of wages/salaries and health and pension benefits needs to be done with great care.

    However, the real analysis has to be one where the productivity, scheduling and work force analysis comes together to support decisions to hire or to use overtime to get the work done.

Your last paragraph contains the material necessary for good decision making. I fear that it will be a tough fight however, since workforce/workload analysis would strike at the heart of a political patronage system which lies at the foundation of political machines. Every workforce "hire" has a financial "tail" made up of pension and other benefits which carry costs to the taxpayer which last the lifetime of the "hire."

  57. It's the constant struggle in government management - making good business policy and decisions as opposed to "good" political decisions. It's the fight between the "Party" and "all the People." Our government has been captured by the politicians - from the State level right down to the Town and Village. Mr. Malone's statement at a Board meeting this year continues to reverberate - "we're the Majority and what we pass, passes." And Chris D. would say the same thing.

    The only way out of the woods is to remove control from those who would operate in this way. It can be done. Jack Conway had some comments a while back about the current operation being run on values from the past, which don't work any more. He's right. Phil and Chris and their followers are anachronisms. Enough already.

  59. Talks is claiming McCabe has a "fraudulent 5". What are they talking about? The OSC audit proved everything that was said, and proven in FOILs was 100% on the money. How insane and delusional are those people? Even after the OSC audit they STILL deny any wrong doing was committed. They took the money and they took in a way that violates the rules of law that govern public funds. That's it, the OSC said pay it back and those people still think they were somehow wronged. Unbelievable. They should put a big iron fence around this town and call it The Hospital and Living Quarters for the Insane & Delusional. They need a team of German doctors to study and diagnose those freaks.

    1. I think it is the "DEMands" blog which purports to be "anti-Malone" which printed something about the "fraudulent 5." That said, you're right about the fact that OSC cited the law about the stipends issue and recommended that the Board seek the recovery of the unlawfully disbursed stipend, longevity and sick-leave payments. To this point, we have seen no action from the Board. It's a matter of character and competence, as I see it. But the fact that OSC cited the applicable law means that the Board can't just ignore the matter and hope it goes away. Take a look at the comments at the very beginning of this post to see the relationship of what should be recouped to the tax increase imposed for this year.

Second, all the documents which were involved in the stipend matter came from the Town's own records, and some were in his own handwriting. Third, the matter of the unlawful longevity and sick-leave payments to the Supervisor and Receiver of Taxes was brought forth by OSC itself as a result of its own review of the Town's financial practices.

    O'Brien - flaming hypocrit. Fake photo op specialist. Husband has a useless, pretty much fake job in town hall.

    Matters - faded the last few years. Got blown away when Cristo and Danaher bailed on him. Good guy otherwise.

    Malone - arrogant. Has contributed not one thing in his current term on the town board. His mother has a good paying do nothing job in town hall. Automatic disqualifier for any future office, in my opinion.

    DiMartino - can she help taxpayers get back the taxpayer money her brother-in-law allegedely stole? If not she can take a hike.

    Cherubino - same old good old boys and girls club.

    Slater - good guy right up to when he linked arms with Malone. The jury is still out.

    DeFruscio - the leader of nothing. The Republican Committee is a non factor. No one will ever forget or let go of the Martha letter fiasco.

    Murphy - nicest smiling, sweetest little stipend graber you will ever meet. When do we get our stipend and longevity money back Ms. Murphy?

    Kennedy - nice lady.

    Langley - leadership is a zero - a big fat zero.

    Of everyone listed the one with the most potential promise, in my opinion, is probably Joe Slater. How connected or disconnected he makes himself to Phil Malone will be the make or break decision for my vote. The rest are pretty much useless in terms of being given taxpayers' trust, confidence, money and, most importantly, vote.

  73. Our county legislature needs a shift in political majority as well as our town here in East Greenbush. You see , political change allows for different points of view to be realized, and this would create a fairness for us all to experience.

    Our forefathers intended for this process to be our guide to govern when they formed their vision of our democracy by which we live. Our system doesn't need to be changed as much as the current majority's do.

    It's really not that complicated, vote for change and create the long overdue balance we deserve and desire. Throwing anonymous rocks at our local government officials is not the answer. I'm fairly confident that much of what is said here would not be something any respectable person would say to another person face to face. A little respect really does go a long way. The nasty comments expressed here need to be be changed as much as our current town and county majority's. Create change the way it was intended, get out and Vote.

  75. Last Saturday at the East Greenbush Little League Parade our new Senator Marchione and Phil Danaher, our longtime legislator turned out to support the kids. These two fine elected officials were joined by several Democratic elected officials supporting the players and creating a sense community.
    In contrast, today's Advertiser features a paid Advertisement by Keith Langley with photo of himself and his hand-picked candidate for Town Board, Debbie DiMartino at the ballfield. Granted, Mr. Langley is a member of the Independence Party but this event was for the kids not Mr. Langley's self promotion.
    I suggest that the two "I like Langley's" above tell their guy that it's not nice to disrespect the other elected officials. He cannot, as suggested by his likers, move up to the County without recognizing and honoring a non-political, community event.
    I feel sorry for Ms. DiMartino. She is a novice and if elected, she might seize the opportunity to learn government. With Mr. Langley at her side, however, she is doomed. Mr. Langley had ample opportunity to learn government and either wouldn't or couldn't learn.

    1. Ms. DiMartino has said, quote: "I will continue the work that Supervisor Keith Langley is doing..."
      So, if you think Keith Langley is doing an excellent job as Supervisor, then you should probably consider voting for her. If not, them you should probably consider voting against her.
      To her credit, she makes no bones about it that she is a Langley loyalist and nothing else.
      Nothing more, nothing less. She will do what Keith tells her to do. What that will be is anyone's guess.
      In short,a vote for DiMartino is a vote for the Langley policies, whatever they are.
      Maybe this campaign season will finally force Keith Langley to spell out what (if anything) he stands for on a number of important issues. Including, perhaps how he (Langley) feels about repayment of the illegal stipends and sick leave/longevity incentives.

  80. Speaking about the town dump. My husband had to work this weekend and I had to reluctantly go there to empty the trash cans. I also over heard that joe guy telling someone he was running for town council, and asking him to help him at election time. He was more interested in talking to that person than helping me. By the time he came over to me I had already dumped the trash in the garbage bin. Sorry, but the dump guy just doesn't seem like someone I could vote for to run the town.

If the Republican Committee and Supervisor Langley believe that fake photo ops are a substitute for leadership, a vision for our town and real accomplishments he is, for my money and vote, going to be as disappointed as are the people who supported him expecting something to be different and different better with his election.

    Slowly, but surely, taxpayers and voters are getting smarter. This blog, the Time Union articles, the OSC audit, Jack Conway's Ethics Board resignation letter and much more are showing voters what a bunch of fakes, phonies and frauds are running our town.

    We need new and different alternatives. Is Debbie DiMartino such a candidate? We'll see but these fake photo ops fool no one.

    First off what does someones brother in law have to do with that person? What does Deb's brother in law have to do with her? So I guess we will now judge everyone by the actions of the relatives?

    Second off I don't think that its listed in the job duties of the guys at the dump to throw everyone's garbage away for them, they do it especially for the older people as a courtesy. I could be wrong, but so what, wont be the first or last time.

    1. I agree with most of what you say here Jim. I must take exception when it comes to the transfer station. If removing garbage from residents vehicles is not part of the attendants job description, they should not be doing it for anyone.

      Mr Politico's selective assistance at the transfer station is all about securing votes for the Democrat machine. Older people vote and he wants them voting for the party he supports. Of late it appears as though he may be securing votes for himself.

      You ask when will the BS end. Not until you stop where it begins. Become part of the solution, not part of the problem Jim C.

  87. Jim, I think the concern is that Debbie DiMartino is very much a part of the exact same system that created and allowed to flourish the lack of accountability in the fire department. Do you know what has become of the missing money? I doubt it because it is all beung covered up by the fire department. That's OUR money, by the way.

    The frustration with the transfer station and with Joe Lamountain goes more to his shameless use of taxpayer paid time to lobby for his own and his political friends when he is supposed to be working followed by his strong denials that he does precisely that. People always react strongly to hypocrisy and, unfortunately, Mr. Lamountain displays it in great abundance.

    Blogs are a way for people to vent. You know that. And that's the classic good news/bad news.

  88. A lot of people insist on talking politics with Joe when they go to the transfer station. I know I'm guilty of that. One of the things that happens at the transfer station is that Joe and Reggie get to know so many people because they see them on a weekly basis. Joe talks politics with people who are 'political' but I've heard him talk about family with people, health issues with other people and so on. Conversation is a two way street. I've never seen him initiate a conversation about politics or prosyletize for the democrats with anyone who wasn't interested.

    Working at the transfer station is a virtually unique town job and one that has a greater frequency of interaction with residents than any other position. Joe and Reggie help people with their garbage because they see it as part of the job and, in fairness, because they're both nice guys. If the rumors are true and Joe is a candidate for the town board he must absolutely cease and desist from talking town politics while on the job. That was forbidden by the Code of Ethics drafted by the Board of Ethics and even though the current town board has no interest in ethics I trust Joe would follow an ethical course in that situation.

    I completely agree with almost all of what you have written in this post, particularly when you talk about Joe and Reggie being nice guys. They are also two of the strongest positive advocates for the Town of East Greenbush that I have had the pleasure to meet during my 25 plus years as a Town resident.

    Clearly, advocacy for a specific candidate for office or a specific political party by a Town employee should never occur when that employee is on the job.

    However, I am somewhat concerned with the use of the phrase "talking town politics," as I believe one person's political discussion is another person's First Amendment prerogative.

    I look forward to our hammering this topic out on the "anvil of discussion" in the near future.

    And, from my and other people's observations of the employees in town hall Joe is following a well set precedent in doing way more talking than working.

To Anonymous 2:30 - There is a difference between talking politics on the job, which as Tom Grant points out, is a First Amendment right and using a town job to promote your own or anyone else's specific candidacy. And the difference is between ethical and unethical behavior, as I clearly described in my post. Your accusation that I am encouraging unethical behavior is inaccurate. It's funny that I said nothing but you had a problem with what I said.

    The city's public works commissioner resigned following a three-month investigation into allegations of payroll padding, city officials said Wednesday.
    Commissioner Tom Capuano resigned Monday after running the department for eight years, Mayor Dan Dwyer said.
    Capuano allegedly approved paying public works employees for hours not worked. Dwyer said the employees left work early but were paid for a full day on the job.
    "I had to have absolutely positive proof it was going on. I did an investigation and came to the conclusion that there was something," Dwyer said.
    It has not yet been determined how much money was involved, the mayor said. "There was a lack of oversight," Dwyer said regarding the payroll situation in the department.
    Capuano could not be reached for comment. Capuano has worked for the public works department for 31 years. He earned a salary of $61,516 as commissioner, according to the 2012-13 city budget.
    The department has 33 full-time employees and two part-time employees, according to the city budget.
    City Attorney David Garvey is reviewing Rensselaer's legal options on how to proceed. The case has not yet been turned over to police for investigation.
    Councilman Dominick Tagliento of the 5th Ward has assumed the commissioner's responsibilities and, the mayor said, has taken immediate action to correct the situation.
    The Common Council will decide whether to keep Tagliento or hire a new commissioner, Dwyer said.

    1. Yes, maybe the event in Rensselaer is like an event in East Greenbush called "lunch day". My understanding is that on lunch day a vendor who does business with the Town provides "free lunch" and all of the DPW crews are called to the garage to enjoy.

    Dear Gadfly: There is no question that you express a commitment to seek a responsible government for the town. It is said that the definition of insanity is to do the same thing over and over and end up with the same result. With all due respect there is a pattern to your approach.

    You and your followers are quick to be critical of the Supervisor without consideration of his minority position on the Town Board.

    Most will agree that stipends were wrong, and longevity and sink pay benefits were handled incorrectly in the past. But that was the past, and the future is what is important now.

    Wasting time and taxpayers money on legal fees to try and recoup money that will never be collected is a wasted effort.

    Why not get behind the Supervisor and support Cherubino/DiMartino. Give them a chance to get this town on the right track.

    Keith Langley is a good man and I supported him during his campaign and continue to do so now. I ask you to do the same. You would get a lot further ahead working with him, and at the end of the day our whole town would benefit. Please stop this negative crusade and work together.

    1. Quite frankly, I think it's insane to continue to "roll over" for the majority, thinking that in doing so they are somehow going to like you and permit you to accomplish a positive agenda. Ms. O'Brien fired the first shot before Mr. Langley took office in lowering his salary. This put the minority in a dither, rather than formulating a strong counter agenda. As Mr. Malone says, the majority will do what it wants to do. In some cases it is important to make that "doing what it wants to do" very public.

    Can you do that and exclude those things the town has forced to do by the state and by citizen activism?

    Can you explain why Supervisor Langley reduced the principles of open government at town board meetings?

    Can you explain why Supervisor Langley has failed to produce a financial turnaround plan for our town?

    Can you explain why Supervisor Langley cannot articulate a vision and goals for our town?

    Can you explain why Supervisor Langley votes with the majority 99% of the time?

    Support is based on achievements not fake photo ops. Please try to figure that out sometime before election day if you want support.

    I am confident that Supervisor Langley would grater support if he were more of a leader qnd more of q communicator.

    I suggest to you that his allegince to Messrs. DeFruscio and Mulvey are less a part of the solution and more a part of the problem.

    I suggest to you that engaging the former supervisor, Mr. McCabe as a consultant was not a wise thing to do if support from non Democrats is important.

    There's more but Supervisor Langley uses not having a majority as a convenient excuse for his own leaderaship shortcomings. That's my view anyway.

It takes a great deal of patience and understanding to create effective change. Politics is a complicated process that you must experience to understand.
