Here's the text of the Times Union Editorial from Friday the 25th. What apparently has gone on there has unfortunate parallels to the mischief that took place in East Greenbush related to the casino fiasco. I can't figure out how the planning/approval process avoided SEQRA. No environmental impact? Looks like the only way to stop this kind of abuse of the public is to remove the "perps" from office.
"Schodack planning officials may or may not have broken any laws, but
they certainly broke the public trust when they withheld details about a
new development until the last minute, and then rushed through a vote
to approve it the same night.
This exercise in cloak-and-dagger governance came complete with a
code name, “Project Red.” It might be humorous, if it were not such a
case study in official arrogance.
This mysterious development first came to light in May, when the town
divulged this much – that a 175,000-square-foot building was proposed
near routes 9 and 20, that it would that it would some kind of
warehouse/distribution center, and be a round-the-clock operation.
That’s like saying a food and drink establishment of some kind is
locating in your neighborhood, and it’ll have music. What are we talking
about? A French bistro with a string quartet, or a dance club with a
sound system worthy of a concert hall? A family place or something
involving pole dancers?
The full details were kept secret under a “confidentiality clause”
that Town Supervisor Dennis Dowds was legally binding. It was not until
this past Monday that the company’s identity, McLane Foodservices, was
revealed – three months after what passed for a public hearing was held.
Clearly, a public hearing on a project that citizens don’t have the
full details about is a mockery of open government. The best residents
could do was ask generic questions about a generic proposal. Perhaps
that’s what the town preferred for a site where previous proposals have
failed amid public objections.
More details would have allowed them to ask more specific questions
and raise specific issues. The full disclosure that the town refused to
provide might have revealed some problems with the town’s review and
raised the need for noise, traffic, and environmental studies. Maeve
Tooher, attorney for the Birchwood Neighborhood Association, notes that
the project is on an aquifer, and that documents show widely different
estimates of how many trucks would come and go – ranging from 17 to 75.
But there will be no studies. The firm’s identity and other relevant
details only came the same day that the Planning Board cast its vote.
Such shabby treatment of citizens is reminiscent of how things were
done in the waning days of the cronyism that was once standard operating
procedure in places like Albany, where public boards met at
inconvenient times while people were tied up at work and unable to make
their voices heard. Where development in the environmentally sensitive
Pine Bush was rammed through. Such shenanigans were finally reined in by
courts that set the city straight on good government, and by voters who
booted politicians who were happy to serve as rubber stamps for
well-connected business interests.
Schodack officials would be wise to heed the lessons of that history,
or risk a fittingly public embarrassment, in the courtroom or at the
polls."
It used to be that politicians at least pretended to care about the will of the people but the U.S. Constitution has lulled us all into such a false sense of security and complacency (by asserting our "inalienable rights" under the law) that we're barely paying attention to government anymore, especially at the local level, much less participating in it. So busy are we with the business of our own lives that our own governor recently proved that politicians can bloody a lot of noses and still survive re-election. Suddenly, bogus "confidentiality clauses" are being used as justification to keep taxpayers in the dark until backroom deals are done and ready to be sprung on us. We had our own "exercise in cloak and dagger governance" last year when our own "Project Red," called Capital View Casino & Resort, suddenly appeared out of nowhere, like a bad rash, and next thing we knew town board members were voting on whether or not to host a full blown, neon lights casino on quiet, residential Thompson Hill. Now, our own supervisor Keith Langley is hoping to survive re-election on 11/3 after bloodying a lot of noses last year. Can any of us forget the arrogance of this man in the spring of last year when panicked residents pleaded for reasonableness and a referendum on the subject? We were told no time, no money for such a thing and that's if we were told anything at all amidst mostly silence and blank stares. Additionally, town democrats now want to add insult to injury by asking us to trade off Langley for Dave VanWormer and return to the equally bad McCabian era of junk government that ultimately got us six years of junk bond status. Thank God there is another alternative this year but it's a one time only offer, folks, so act now. ReplyDeleteWhat infuriates me is the election year jocularity of a supervisor who has done nothing but look down his nose at people since he was elected. Supporters were excited when he took office and they wanted to help, to get involved, but right away, amidst his mythical "open door policy," he shut the door in their faces, including, it appears, on board members who wouldn't bow to him. Now he's playing slap (then) and tickle (now) in his bid for re-election. Are we going to fall for it and be stuck with him for four more years, especially when we have Dr. Conway, Ms. Tina and Squire Tom at the ready? We who vote have to take back our power, THE ONLY POWER WE HAVE, and say, 'I have a good memory, Supr. Langley. I remember!' If Langley sprung a CASINO on us last year, what is in store for us next year in the vacant K-Mart or Weathervane locations, for example, or even on the now famed Thompson Hill, which is for sale? The developers are licking their chops over EG as we speak. We witnessed a den of ill repute make its way into the old Bumbys store on Col. Tnpk, just minutes from a church and town hall. Remember the Honey Bee (prostitution) Spa? The message has now been sent to the business community that EG is open to any unsavory business that wants to set up shop here. So, especially with hardcore politicians like Keith Langley, it's important to remember. Follow what's happening in Schodack right now and on 11/3, vote for Jack, Tina and Tom. You will be so glad you did.
ReplyDeleteIt's really a shame, and boarders on big time duplicity that the Supervisor can't or won't submit the "documents" which allegedly support his claim about reduced debt to audit. He's making huge campaign claims, but won't submit the documents for review by competent professionals. But Moodys has called his hand. The Junk Bond status which we got under the McCabe administration has now been reduced another rung - to the bottom - the watch list - by Langley's refusal to submit the Annual Update Documents sent to the State Comptroller's Office to independent audit. He wants to claim the "truth" of what they supposedly say without having the truth checked. Just another McCabe with a different Party shirt.

According to the town website, the supervisors 2016 tentative budget will be presented to the town board on Thursday 10/1 at 4 p.m. but the announcement emphasizes that there will be no presentation of the content of the budget (that conveniently comes AFTER the election). Yup, the supervisor has all the bases covered but can board members ask questions about the budget on 10/1 or are they just expected to leave the meeting with budget in hand and tail between legs? They must have pressing questions that will aid them in their review of the budget over the next month but will King Langley allow it? This remains to be seen. You might want to bring the camera, Don.

11/20 a.m. Good question but the answer is no. The meeting is literally just to hand the budget to the board members who will sign their names in attestation to receiving it on or before 10/5/15. The meeting will then adjourn. The budget will be posted on the website on 10/2 for public consumption. The public hearing on the budget will be on 11/5 when a presentation will be made most likely primarily by the Comptroller.

Gadfly, nine months after the state Gaming Facility Location Board approved three sites for upstate casinos, the state Gaming Commission has yet to grant the final licenses for the projects in the Finger Lakes, Catskills and Albany areas, Gannett’s Albany Bureau reported on 9/28. The article also says that under the law, the casinos would have two years from when they are issued the licenses to open — or they would face getting stripped of the award. What can we conclude from this information. In other words, what are the possibilities? Is EG still at risk for being awarded a casino?
ReplyDeleteI live on a fixed income. After January, how much is my water and sewer bill going to go up to pay for the multimillion dollar sewer plant upgrades including the bad spill that happened? I recall that one of the board members asked for a professional study to be done by one of our consultants but it was voted down. So how will our rates be determined? Those of us on tight budgets need to know so we can plan.

Mr. Langley has refused to answer any questions about this issue for the last eight months. What's Mr. Langley hiding?

I don't know anything about you but I do know that residents will be faced with approximately a $700,000 bill per year for the next 20 to 30 years to pay off the loan for the new sewer plant. And like when a person builds their own home, the costs keep increasing. The spill that was supposed to be covered by insurance except for $1,000 is costing the town upwards to $400,000 in uncovered costs. Supervisor Langley is keeping the financial condition of the town a closely guarded secret until after election day, so even if you come to the board meeting, you won't get any information, just blank stares. If Keith Langley or Dave VanWormer & company win election, we're all going to need second jobs to pay our taxes and fees. It's frightening what's in store for us. Please go to EG1st.org for info about candidates who care about whether or not you can pay your bills.

DeleteBut insurance so far has paid for all but approx $400,000. I remember at the special meeting for the plant expenses though that the Comptroller said that "if the town's share of the cost of the accident gets into the hundreds of thousands, we'll be "in trouble." In trouble how? No one will say. Will our water and sewer rates be skyrocketing? It's infuriating that we're not being told. Everyone should be raising cane about this.

ReplyDeleteThe water/sewer rate study may not fix our town's finances, but it will ensure the residents are being billed properly for their usage. As it stands, Delaware Engineering has said that the current rate system is out dated. They used an example of one of the districts using frontage, so an old lady whose house may be set back farther than a gas station would be paying more than the gas station, even though the lady uses significantly less in water and sewer. Malone and Langley are ok with this fact.
ReplyDeleteAll we want is to be billed properly for our usage. Doing things right might not be important to our supervisor but it's important to us. Does Langley even get billed by the town for anything? Maybe that's why he doesn't care about bills.
DeleteThis is outrageous! The WWTP project is supposed to be done in November but still not a word from Langley about our rates. The consultant said that the study would have to be done THIS month if the town was to be ready to start billing us next year. But no study, no nothing! Are they going to GUESStimate what our rates should be? Geez, now I'm worried, too.
ReplyDeleteI wonder how many hundreds of thousands of gallons of additional water passed through the WWTP plant due to the 4 inches of rain we had in the last 24 hrs. All rate payers will pay for for the excess needing to be treated.The town building dept, has turned a blind eye to sump pumps and foundation drains tied into the sanitary sewer.
ReplyDeleteI'm suprised the Feds (who help fund some of the pollution remidiation in town) can't or won't test for illegal sump pump connections.
Just remember all those people with sump pumps and foundation drains tied into the sanitary sewer pay the same rate as the rest of us....Talk about UNFAIR...,But this is East Greenbush.
So,those who have those sump pumps,foundation drains ans gutters tied to the sewer ,you get a free ride while we pay for you being cheap.
Jack,Tom,and Tina have every vote in this household...They know the meaning of fair and honest,But,they have their work cut out for them.
Jim, thank you very much for your comment. There is a lot to straighten out here in our Town. I discovered some time ago that the previous administration had put a former Planning Board Chairman on the Town's health insurance plan at the expense of the taxpayer. The history is full of these kinds of abuses. It has to stop if we are to survive, but the "insiders" have been running the place for a long time.
DeleteSlowly it is becoming more and more clear just how much of the cost of the sewer plant spill in March insurance WON'T cover. It's creeping up to a million dollars out of EG resident's wallets. Remember when they passed the resolution that said it would cost the town a $1,000 deductible? Baloney! That extra million will be figured into the water and sewer rates next year. If you think a gallon of gas is expensive, you ain't seen nothin yet.

I live on Castleton Avenue. Tina Tierney and Tom Grant stopped by the other evening They are running for town board. I was very impressed by them both. They listened very respectfully to what I had to say about the problems we have had with the town and they answered all my questions. I will be voting for both of them on election day. They are a breath of fresh air that we desperately need. I just came in from talking to one of my neighbors about them As it turns out they had stopped by her house as well and she is just as impressed by them as I am.
