Let's Put an End to the Irresponsible Fiscal Oversight

The Post below is from East Greenbush Truth.  It's too good not to be a "guest editorial" on the Gadfly.  Read Away!!

We are 11 days away from one of the most contentious elections in East Greenbush and our East Greenbush Republican Committee has failed to file 5 of the last required financial disclosure reports to the Board of Elections.  This is the same committee that has helped run our town further into the ground over the last 4 years.  This is the same committee who is supporting a CFO who has also played a hand the deteriorating condition of our town’s financial records. Our town’s credit ratings have fallen below junk bond status, with 3 of our general obligation ratings now completely withdrawn because our CFO, under the leadership of our EG Republican party, has failed to provide an audit of our town much like the committee backing him has failed to file their required financial reports.  Our Supervisor has failed to provide a verified audit in his tenure as our town’s CFO.  We not only became the laughing stock of the Capital District when our town was put under a microscope during the casino fiasco, but we were embarrassed to find out that we paid two respectable accounting firms nearly $70,000 to attempt to complete an audit but were unsuccessfull because our financial records are too much in disarray.
The committee is requred to file a 32 Pre Primary Report, an 11 Day Pre Primary Report, a 10 Day Post Primary Report, a 32 Day Pre General Report, and an 11 Day Pre General Report – none of which has been filed.  New York Election Law requires that any candidate or committee raising or spending, or expecting to raise more that $1,000 must file.  Candidates and committees must disclose all financial activity made in connection to their own campaign or in support of a candidate.  Candidates who do not exceed the $1,000 threshold may file an “In-Lieu-Of-Statement,” however NY Election Law prohibits constituted and party committees from filing such statement.  NY Election Law 14-124(4) states:  “The only committee that can file In-Lieu-Of-Statements are authorized committees supporting one candidate or a committee solely supporting or opposing a ballot proposal/proposition.”
If there is no financial activity, then such candidate or committee must file a “No Financial Activity” report.  It is factual that the East Greenbush Republican Committee has incurred financial activity.  In the July 30th Advertiser, Ed Gilbert wrote an ad supporting Keith Langley that was explicitly paid by the East Greenbush Republican Committee.  Ironically, this piece was to call out former candidate Michael Poorman for failing to file his required financial disclosures.  (https://eastgreenbushtruth.files.wordpress.com/2015/03/ed-gilbert.png)  On September 3rd The East Greenbush Republican Committee paid for two ads in The Advertiser, “A Message from East Greenbush Republican Town Chairman Dan Fiacco ‘Supervisor Keith Langley Deserves Re-Election'” (https://eastgreenbushtruth.files.wordpress.com/2015/03/republican-committee.png) and the infamous “Turnaround” ad (https://eastgreenbushtruth.files.wordpress.com/2015/03/langley1.png).
The East Greenbush Republican Committee has hosted at least two fundraisers since the July Financial Disclosure Report, one on August 11th when they hosted the “Fundraising Reception in Support of Larry Lenartz and Trent Tibbitts” and the other on October 13th for their “Celebration Event.”  Both events requested that checks be made payable to the East Greenbush Republican Committee.
In 2011, before our Supervisor took office Moody’s had actually upgraded our credit rating from “negative” to “stable.”  Two years later when our Supervisor was in office for a year and a half we were put on a list of cities/towns facing bankruptcy.  Almost 4 years into our Supervisors role as CFO Moody’s downgraded us and withdrew our credit ratings.  Is this the person or committee you trust?  The pattern of our CFO and his respective Republican Committee failing to provide the necessary financial disclosures (for our town, a verifiable audit) needs to end.  We the residents can make that happen on November 3rd, 2015, our town has suffered enough!

It's crystal clear that Langley and his merry band of misfits think they're above the law!

  2. Langley has been setting out to prove since day one of his term that he makes HIS OWN rules and laws. Town law? State Finance Law? Makes no nevermind to him. He ignores them all equally. The man is a fraud who spends more time out of the office than in. We need someone who will actually be a supervisor, not just play one. We need Jack!

  3. Unbelievable!
So let me get this straight...
    1. Keith Langley has not allowed the general public to ask questions at Town Board meetings. Even Rick McCabe answered questions during his time as Supervisor.

    2. Keith Langley and his "team" were unable to free up some time from their "busy" schedules to participate in the candidates debates held at CHS. Both EG 1st and the EG Democratic candidates participated in front of a large crowd of spectators (and voters).

    3. The East Greenbush Republican Committee, which is sponsoring the campaigns of Keith Langley for Supervisor and Larry Lenartz and Trent Tibbitts for Town Council, has refused to file the LAST FIVE Financial Disclosure Reports with the NYS Board of Elections.

In my humble opinion, anyone choosing to vote for Langley, Lenartz and Tibbitts just isn't paying attention.

As for me, I'll be voting for Jack Conway, Tina Tierney and Tom Grant on Election Day.

  5. I just finished reading "East Greenbush in a Bad Moody's" and "Mr. Langley is Stone-Walling" on pages 5 and 25 of yesterday's Advertiser and I'm not getting the problem. If Keith Langley has been supervisor since 2012, then why doesn't HE vouch for the numbers in the financial statements? As Chief Executive and Chief Financial Officer of the town, he can sign a management letter. Is he saying that he can't vouch for the numbers that were generated on his watch? If not, why not? How is it that this has been going on for years since he took office? Is he not paying attention or is he flat out hiding something that he doesn't want discovered? Shouldn't we find out before we re-elect him?

    1. That's exactly my point. He's submitting AUDs to the State Comptroller apparently indicating that he's solved the interfund debt problem - and making campaign claims related to that. Yet he won't "certify" the submissions and open them to audit. Go figure. Just remember that Chris DeF is behind the scenes orchestrating this operation. The big lie and mischief are on the menu.

  6. @ 8:49 PM- That's why it is important to not re-elect Langley or elect his running mates, Lenartz and Tibbitts. We need a new team at Town Hall that will work for the people of East Greenbush and not for the special interests.
I believe the best team for East Greenbush can be found at the bottom of the election ballot.
Their names are Tina Tierney, Tom Grant and Jack Conway.

Vote FOR Tierney, Grant and Conway on Election Day! They are the choice for positive change.

  9. Is it too late to run "The Truth" article above in the Advertiser for next Thursday? I'll help pay for it if someone can organize it. Folks, 99% of those on this blog will vote EG1st, but the general population is not reading this blog. They are oblivious to whats going on. The Advertiser reaches out to many that don't go online.

Again, encourage your friends and neighbors to vote EG1st and make sure they encourage their friends and neighbors, its the only way to get enough votes. The Party machines will pull out all the stops in the next week to get their faithful out to pull the D or R lever to maintain the status quo...hogs at the feeding bin working at self-preservation. PLEASE talk to everyone you know and have them do the same. The only way to pull this Town back.

  10. Good idea. Someone that doesn't mind using their name should forward the article to the Times Union actually. Can't believe they wont run a nice juicy story like that in the paper. Maybe blame it on Cuomo and the State Legislature's lack of ethics filtering down to local government and it will get some traction.

  11. Our household just received a mailing from EG1st regarding how to find them on the 11/3 ballot. It's easy peasy! Just scroll your eyes down to Row I and color in the circles for Jack, Tina and Tom. It's so easy that even Keith, Chris and Eddie G. could do it and, if they care anything about the town of East Greenbush, we hope they do! This has been a harrowing two years. The town is NO BETTER OFF than it was when Rick McCabe was in office. Mr. Langley can't prove any of his claims that we are better off. ARE YOU BETTER OFF? He wants you to think so but if you're not, please consider voting for Jack, Tina and Tom (Row I). They are a team of educated professionals who will know how to properly manage the massive debt for the sewerage treatment plant upgrade that's been going on since Langley took office. In addition to the $14 million dollar loan for the plant, there are TWO mishaps at the plant that have generated a stack of insurance claims that the town's insurance company may or likely may not pay. There are issues regarding who is at fault for these mishaps that are causing the contractors to walk off the job early. In a nutshell, it's a mess. When CP Matters called for special outside counsel to protect the town, Langley and Junior Malone voted NO! The town is in a crisis of incompetent leadership. We are now a mere 10 days away from solving the problem by voting for Jack Conway, Tina Tierney, and Tom Grant.
VOTE FOR ALL 3 ON 11/3!
    Thank you!

  12. Ed Gilbert e-mailed these words to me yesterday:
"The Matters brand has been mangled to such a degree I fail to see how you or Rick can think that any political  party would seriously consider endorsing either of you in the future."
Because I claimed in the Times Union last year that a "Republican drone" attempted to extort my vote by threatening my husband's political future in East Greenbush, I thought you would like to see that it's still happening by the same "drone." I have the e-mail. How can an elected official perform the duties of her office responsibly under these circumstances? The supervisor has made no effort to rein this "drone" in. He has allowed him to pressure and browbeat me for months for his own benefit. We need new leadership. Please help me to help you by voting for Jack, Tina and Tom on 11/3.
    Ed Gilbert also wrote:
"To be fair I take some responsibility for ratcheting up the rhetoric after your attempts to have me fired."
Is this an admission of responsibility for the EGMatters blog? I take it as nothing else.

    1. It appears that Langley spokesman Ed Gilbert is doing ALL the talking at board meetings, in the Advertiser, and in e-mails. Question: Is Langley mute? Who really cares what Ed Gilbert "fails to see?" Was his "ratcheting up" of the EGMatters blog his way of supporting the supervisor? Is Langley spokesman Ed Gilbert on the EG Republican Committee payroll? Is that part of what they're hiding by not filing their financial disclosure forms? We need them OUT! We need Jack, Tina and Tom IN!

  13. Gadfly, normally I come down on the side of letting everyone say their piece, but it is now the last week of a most important election season. Neither Matters nor Gilbert is running so I'd like to suggest that Ed and Maryann get off the stage this week and take their feud with them.
Could you please help us get back to the issues?

    1. Good point. The reason I posted it was that it seemed to me to indicate that the Republicans are running scared. An across the board loss would seem to me to be a call for completely new "leadership" for the Rep camp. It would put DeF off the bus.

    2. 12:46 p.m. The way I see it, MA has taken a lot of cr&p for rejecting the Langley camp. She got an e-mail from that self-righteous, dolt Gilbert that proves past claims she's made and she wanted to share it. Eddo's stupidly brazen comments also PROVE that NOTHING in the Langley camp has changed and that they're still a bunch of bullies who refuse to grow up. I think she's showing us that these are NOT the kind of people we want running the town and she's right! In our house, we're voting for intelligence, class, and sophistication. We're voting for Jack, Tina and Tom on 11/3.

    3. This isn't a Gilbert/Matters feud, it's much more than that. It's a very real Langley/MA/DiMartino problem whereby our supervisor can't get along with two out of four board members, so he sends his boy Elroy to turn the screws on them. The supervisor should be able to get along with and work with ALL board members and keep them fully informed so that they can do their jobs for us. This would never happen with Jack, Tina and Tom in office. It will continue to happen with Langley or Van Wormer in office. We need a fresh start and a clean slate. We need Jack, Tina and Tom.
PLEASE VOTE FOR ALL 3 ON 11/3!

    4. Amazing that Langley spokesman Ed Gilbert would put that in writing! Not too bright, eh? Mr. Ed's been stumping for King Keith since MA and Debbi D. were elected. He really ramped up the "rhetoric" when King Keith made him Deputy Water Carrier so he could come out and sell the casino. Looks like that plan failed, too. Awww. King Keith oughta push his boy Elroy aside and speak for himself for a change. He's got two months left to give it a try.

    5. Langley has tried the tactic of sending an errand boy before. He had Gilbert invite Don, Dwight and I to a steak cookout. We were asked to be quiet. We were asked to ignore our Constitutional rights.

All three of us opted to fight for the town and the people instead of Ed and his puppet master Langley .

    6. Shortly after he was elected Langley offered me an appointment to the CFAC. It came with a condition. The condition was no commenting at town board meetings. No articles in The Advertiser. No blog comments.

I turned the appointment down. I had no interest in such a totalitarian form of town government.

Ed, apparently, drank the Kool Aide.

      Delete
  14. I strongly recommend that everyone who's thinking about re-electing Keith Langley do a little research back to 2011 and think about what's changed.
In the October 2011 issues of the Advertiser, Mr. Langley made the following assertions...
"East Greenbush residents are concerned about higher taxes, a huge debt that caused town finances to be reduced to junk bond status and controversy and conflict."
Well, four years later, taxes haven't changed, Mr. Langley, we have no clue about the debt that remains, and NO bond rating. Controversy and conflict remain a daily occurrence in the town, especially at town board meetings every month.
"We have come together to make a difference based on the following goals:
    Stabilize property taxes (FAILED)
Restore the town's bond rating (FAILED)
Reduce the towns record high debt (UNPROVEN/FAILED)
Independent audit of town's finances (FAILED)
Restore openness to town government." (FAILED)
"We are prepared to fight taxes, be more responsive to the needs of residents and restore our credit rating..."
How have you fought taxes, Mr. Langley? Please explain. In 2015, our credit rating IS NOW GONE because East Greenbush has failed to produce certified audits of its fiscal records. As Chief Financial Officer, Mr. Langley, you could certify the documents and prove your claims of reducing the debt...but you WON'T, not can't, WON'T. What are you hiding from us?
"Elective office is not a right, it needs to be earned and we are prepared to earn your confidence."
When will you start earning our confidence, Mr. Langley? The infamous "Turnaround" should have started TWO YEARS AGO when you gained and soon after proceeded to destroy your majority status on the board.
"IT'S TIME TO PUT PEOPLE FIRST (caps in the ad). East Greenbush taxes are too high, the debt has grown too much, and town finances have been downgraded to junk bond status."
Junk bond status to NO bond status equals another FAILING grade, Mr. Langley.
As the expression goes, three strikes and you're out.
VOTE FOR JACK, TINA AND TOM...ALL 3 ON 11/3

  19. In the interest of full disclosure I heavily supported Langley four years ago. I signed his petition , I supported him with my writings and my talks. I contributed a lot of money.

When the infamous Martha article was exposed I tried to stop payment on my check but it had been cashed by Mulvey.

I spoke to Langley several times after his election. I was stunned by his vulgarity, his anger.

I thought he was the most ineffective negotiator I ever met as Ginny O'Brien played him like a fish on a line.

I listened to Langley whine about not getting a majority.

I thought his public speaking skills were terrible.

I also got to know Jack Conway. And discovered a smart, caring, super good guy. Same with Tom Grant.

I hope they prevail next week. The town needs them and they deserve everyone's support. And Langley needs to be what he really is. Yesterday's news. Same for Dave Van Wormer.

    3. This would be the same exact building. Maybe if our Planning Board asked what the space would be for they would have concluded the same as the liquor authority (that there were enough liquor stores in a small area) and not helped in aid in another vacant lot in EG. Instead, they greenlighted the project because it was a Fiacco. Much like they greenlighted 1 Cooper Ave., even when the law explicitly stated they couldn't get the variance. One has to question, what is the purpose of our Planning Board? I guess with our chairman being a Hart's business partner, and Botilllo being Hart's brother-in-law the answer is "keep it all in the family."

  23. When you vote next Tuesday, folks, remember to connect the political dots.
A vote for either Langley or VanWormer is a vote for DVW's ex-brother-in-law Rick McCabe and the stipendous "family and friends" plan that we thought we were voting out when we elected Langley. Four years later, we've learned that a vote for Republicrat Keith Langley is also a vote for Rick McCabe as nothing has changed since McCabe left office. Langley lost his majority with BOTH CPs DiMartino and Matters early in their term because they literally could not stand how much like Rick McCabe Keith "are you gonna vote for me?" Langley really is. Voting for Lang/Lenartz/Tibbitts/DVW/Stenson or Smyth is the same as voting for no certified audits, no questions during the comment period at board meetings, secret service in town hall, the continuation of a fractured town board, no bond rating, disappearing mitigation fees, high debt, higher rates for insurance, uncertain taxes and fees, a "still learning and discerning" comptroller, shady insider deals with planning and zoning for which no one, including the supervisor, will claim responsibility, a bldg dept that's useless, a bldg inspector who's bought and paid for, and worst of all, Langley spokesman Ed Gilbert! Nov 3 is upon us. You can vote for corruption, incompetence and greed or you can vote for Jack, Tina, and Tom on 11/3. The choice is yours.

  32. Bonnie L. I also like Ms. Carlock, but she needs to find out why the EG Republican committee Treasurer, Sean Mulvey, has refused to submit those Financial Disclosure Reports. I will also not be voting for any Rep candidate until this issue is resolved. This is a major ethical lapse on the part of the Rep Committee and its endorsed candidates.

    1. It's not just an ethical breach, its illegal and a criminal penalty.

    2. As a former East Greenbush Republican Committee member (I served from 1985 to 2002 covering the 7th & 10th Election Districts) I find the blog post blaming the Candidates for the Committee’s failure to publish the Committee’s financial disclosure reports very amusing. I feel the need to educate the reading public of a few facts regarding a Political Committee structure:
      1) The Republican Committee is a separately elected body (Yes, they are elected by their fellow registered Republicans, they circulate petitions and appear on the Primary Ballot. If a position vacancy is otherwise created, the Republican County Committee may appoint a person to serve)
      2) The Committee has an executive board consisting of a Chairman, Vice Chairman, Secretary and Treasurer.
      3) The Republican Committee is responsible for but not limited to the following:
      a. Seeking, support and elect qualified Republican candidates for local, county, state and federal offices
      b. Circulate nominating petitions
      c. Foster loyalty to the Republican Party
      d. Promote an informed electorate through political education
      e. Increase Republican Registration
      f. Raise Funds in support of the candidates
      g. In general to uphold the principles of the Republican Party.
      h. File “timely” all required financial reports
As a former committee member who has been involved in many elections I speak from experience when I say that the candidates have very LITTLE to NO SAY over how the Committee conducts it’s business, spends it’s money or whether or not financial reports are filed timely. The endorsed candidates can offer feedback, opinions and suggest direction but ultimately the responsibility falls upon the committee as an elected body. The candidates are responsible for their own financial disclosure reports. So I say to all the anonymous posters claiming that Keith Langley, Kim Carlock, Kevin Engel, Larry Lenartz and Trent Tibbitts are responsible and should be penalized for actions (or in this case lack thereof) that are outside their control is total Bullcrap! Following that logic then you would also have to hold CP Matters and CP DiMartino to the same standard and paint them with that same brush! Of course they have no say either and cannot nor should they be held accountable! If you check the NYS Board of Election you will see that the following candidates (Keith Langley, Kim Carlock, Independent Mike Poorman and Democrat Dave VanWormer) have all filed the required financial disclosure reports that they have direct control over and therefore in compliance with the law. I call on Eileen Grant and Bonnie Lester to confirm what I say as true as they were at one point Republican Committee members. You want to support the EG 1st candidates, by all means that is your right but stop falsely blaming the other candidates for the Committee’s failure to file as they have no more say then you and I as to when the EG Republican Committee submits the financial disclosure reports! I’m calling out the other blog posters here to make a real attempt to stick to the issues instead of allowing our discourse to devolve into personal attacks, insults and made up arguments.
For the sake of FULL DISCLOSURE on my part I feel it necessary to disclose that I am the Brother-In-Law of current retiring East Greenbush Town Clerk Linda Kennedy and I reside in the Town of Schodack and will not be casting a vote in the East Greenbush election. I’ve been biting my tongue for too long! Over the years I’ve gotten to know Kevin Engel, Mike Poorman, Keith Langley, Kim Carlock, Dave VanWormer, Tom and Eileen Grant and have nothing but good things to say about each of them and given enough time could make the argument as to why each in their own right would be worthy of your support.
      Respectfully submitted Robert Kennedy

    3. Mr. Kennedy, I can appreciate your desire to disassociate the behavior of a candidate's committee from the candidate, but the committee can't be doing much in support of its candidates if it refuses to follow the election law. They really do harm. That cartoon piece slamming DVW says it was paid for by the EG Republican Committee. By the same token, DVW's treasurer attempted to make it appear that the Times Union endorsed DVW. They got caught, and now they are angry. I know it is the "silly season," but the Committee mischief is not doing much to enhance the credibility of their respective candidates.

    4. Mr. Kennedy:
That's all well and good. The specific concern regarding Ms. Carlock is that she also serves as a member of the Town of East Greenbush Republican Committee. As such, she has a fiduciary responsibility to ensure the "timely" filings of all required financial reports. Sadly, she has remained silent about the failure of her Republican Committee to file the last 5 reports. Since the job of the Town Clerk involves the accurate filing and recording of public records a failure to oversee the activities of her Republican Committee rasies serves concerns regarding her ability to effectively serve in the position of Town Clerk.

If this issue isn't publicly resolved by election day, I will be casting my votes for Jack Conway, Tina Tierney, Tom Grant and BRIDGET FRITZ and I will be encouraging my friends to do the same.

    5. Mr. Kennedy,
Your post was well written and it held my interest from beginning to end but you are failing to take one very important thing into consideration and that is that one phone call from Keith Langley to republican committee chair Dan Fiacco to order that the filings be made completely and timely would resolve the issue. Therefore, one is left to deduce that Mr. Langley ordered that the reports remain unfiled until after the election and that they have something juicy to hide. If not, then why wouldn't Langley order them filed when the issue first arose? You can quote the "facts regarding a political committee structure" all day long but the only fact that matters is that Keith Langley is the BOSS and the committee takes their orders from him.

    6. Bob I respect your explanation and for most candidates you are correct, the actions of the committee should not fall on the candidates - until those candidates accept endorsements and money from them and neither legally disclose this. Is Dan Fiacco the Republican chair? Did he not walk door to door with Keith? Keith has failed to produce and audit ,much like Republican committee who Keith and his running mates have accepted endorsements from, has failed to legally file their last 5 financial disclosures. This is also on each of the candidates for not ensuring their campaign is being run legitimately.

  33. Keeping my fingers crossed regarding the Langley Waste Water Treatment Plant on this rainy day. Last time it rained Langley declared an emergency that cost the taxpayers hundred of thousands of dollars.

  34. I usually dislike when others talk about each other's blog, but I have to defend Don on yesterday's article. The person who commented on Talks bashing you either didn't read the article, or doesn't know the relationship of the author and Dave nor the rules of that blog, or is someone who knew about the article and is throwing a hissy fit. In either case, I read the article which I know many couldn't because it was gone before it was up. To the author of that comment, do you really think the Times Union would take down an article because ONE person complained, out of the tens of thousands of people who read their paper? The truth is Jim L. endorsed Dave Vanwormer in the T.U.'s local town blog. The article made it appear it was the T.U.'s endorsement, and did not once disclose Jim's relationship with Dave nor the fact that he is Dave's treasurer for his campaign. A clear bias. The major issue is that with the T.U. blog, political partisan is not allowed with the authors. That is why the article was removed, not because ONE resident complained. (do you think no one else saw it that knows their relationship?)
